OPTIONS AVAILABLE TO THE CABLE COMMISSION <br /> AND MEMBER MUNICIPALITIES <br /> Even though a court would likely reject the city's <br /> attempt to regulate or prohibit the programming of channel <br /> 34, the city or the Cable Commissions could still take ac- <br /> tion to express their displeasure with the Company. Below <br /> please find a hierarchy of actions which the city could. take <br /> from the less extreme (above the line) through actions which <br /> would in all probability be held impermissible by a court .of <br /> law ( listed below the line) . <br /> The Cable Commission or the member cities could: <br /> 1. Take no action. <br /> 2 . Pass a resolution expressing the Commission' s or <br /> city' s objection to such programming on channel 34 . <br /> X3. 1 Pass a resolution expressing the Commission' s or <br /> cit�p4 objection to such programming on channel 34, and <br /> specifically request that the Company remove the adult pro- <br /> gramming from cable channel 34 . <br /> 4 . Pass a resolution expressing the Commission' s or <br /> city' s objection to such programming on channel 34, and <br /> order the Company to remove the adult programming from cable <br /> channel 34 ( if the Company chose not to comply with this <br /> order , any attempt to sanction the Company would in all <br /> probability be held impermissible by a court of law) . <br /> 5. Pass a resolution expressing the Commission's or <br /> city' s objection to such programming on channel 34, and <br /> order the Company to remove the programming from channel 34 <br /> within 15 days of written notification- or face the fines and <br /> penalties provided for in the franchise. . <br /> 6. Pass a resolution expressing the Commission's or <br /> city's objection to such programming on channel 34, and <br /> order the Company to remove the programming or face termina- <br /> tion procedures of the franchise for failure to comply with <br /> • the franchise sections prohibiting x-rated or otherwise <br /> pornographic material . (This step would not be available to <br /> the Quad Cities Commission. ) <br />
