• <br /> NOW THEREFORE, the Declarant does hereby make the following <br /> Declaration: <br /> 1. Declarant does hereby declare that the Meta Property is hereby sub- <br /> ject to the right of the Association, their successors, heirs, <br /> invitees, assigns and agents to park vehicles within certain <br /> designated parking spaces, which are shown on Exhibit B, attached <br /> hereto and made a part hereof ("Overflow Parking Area"); subject to <br /> the following provisions : <br /> a. The total number of parking spaces available to the <br /> Association at any particular time shall be twelve (12). The <br /> spaces shall be those designated on Exhibit B or such other <br /> spaces which shall be designated from time to time by the <br /> owner of the Meta Property. <br /> b. The times during which the Association may use the Overflow <br /> Parking Area shall be between the hours of 5:30 p.m. to 11:00 <br /> p.m. on each day, Monday through Friday, and from 12:00 -noon <br /> to 11:00 p.m. on Saturday and from 8:00 a.m. to 11:00 p.m. on <br /> Sunday and Christmas, New Years, Memorial Day, Labor Day and <br /> • Independence Day and only at such times. <br /> C. The Overflow Parking Area shall be used only for the parking <br /> of motor vehicles of guests, licensees, invitees , occupants of <br /> the Condominium and the Association members all of whom may <br /> be determined from time to time by the Asssociation. <br /> 2. The Association shall pay as and for consideration for the use of <br /> the Overflow Parking Area the monthly sum of Ten ($10.00) Dollars <br /> per designated parking space. <br /> 3. The term of this Agreement shall be the term of one (1) year com- <br /> mencing the date hereof and shall be automatically renewable sub- <br /> ject to the right of either party to terminate this Agreement upon <br /> ninety (90) days written notice to the owner of the Meta Property, <br /> if by the Association or to the President of the Association, if <br /> by the owner of the Meta Property. <br /> 4. The owner of the Meta Property and the Association agree that they <br /> will acquire all necessary policies of insurance to protect their <br /> respective interests in the property and all necessary public <br /> liability insurance and to the extent permissable or required by <br /> law, will include a waiver of subrogation provision. <br /> 5. This Agreement shall not be assigned by the Association without <br /> the written consent of the owner of the Meta Property, which con- <br /> sent shall not be unreasonably withheld. <br /> -2- <br />
