• NOW THEREFORE, the Declarant does hereby make the following Declaration: 1. Declarant does hereby declare that the Meta Property is hereby sub- ject to the right of the Association, their successors, heirs, invitees, assigns and agents to park vehicles within certain designated parking spaces, which are shown on Exhibit B, attached hereto and made a part hereof ("Overflow Parking Area"); subject to the following provisions : a. The total number of parking spaces available to the Association at any particular time shall be twelve (12). The spaces shall be those designated on Exhibit B or such other spaces which shall be designated from time to time by the owner of the Meta Property. b. The times during which the Association may use the Overflow Parking Area shall be between the hours of 5:30 p.m. to 11:00 p.m. on each day, Monday through Friday, and from 12:00 -noon to 11:00 p.m. on Saturday and from 8:00 a.m. to 11:00 p.m. on Sunday and Christmas, New Years, Memorial Day, Labor Day and • Independence Day and only at such times. C. The Overflow Parking Area shall be used only for the parking of motor vehicles of guests, licensees, invitees , occupants of the Condominium and the Association members all of whom may be determined from time to time by the Asssociation. 2. The Association shall pay as and for consideration for the use of the Overflow Parking Area the monthly sum of Ten ($10.00) Dollars per designated parking space. 3. The term of this Agreement shall be the term of one (1) year com- mencing the date hereof and shall be automatically renewable sub- ject to the right of either party to terminate this Agreement upon ninety (90) days written notice to the owner of the Meta Property, if by the Association or to the President of the Association, if by the owner of the Meta Property. 4. The owner of the Meta Property and the Association agree that they will acquire all necessary policies of insurance to protect their respective interests in the property and all necessary public liability insurance and to the extent permissable or required by law, will include a waiver of subrogation provision. 5. This Agreement shall not be assigned by the Association without the written consent of the owner of the Meta Property, which con- sent shall not be unreasonably withheld. -2-
