Burt <br /> City Manager <br /> St. Anthony Village <br /> 3301 Silver Lake Road <br /> St. Anthony, Minnesota 55418-1699 <br /> Re: Quit Claim Deed for part of Town & Country Food Store <br /> Property, 2550 Highway 88, St. Anthony, Minnesota <br /> Dear Mr. Burt: <br /> This letter is in response to your request for Osborne <br /> Properties to execute a Quit Claim Deed for a portion of the <br /> referenced property. There are some legitimate concerns that <br /> need to be addressed before consideration is given to this <br /> Quit Claim Deed. <br /> • First, agreeing to the Deed severely impairs the value and <br /> future development of this property. As you are aware, the <br /> proposed property to be deeded, runs through the middle of <br /> the property. In addition, the City would like us to execute <br /> a private utility easement for Autumn Woods which connect to <br /> the public utility lines for which the City is requesting a <br /> Quit Claim Deed. These lines were installed across our <br /> property without our knowledge or consent. We have already <br /> denied the private utility easement as this further decreases <br /> the value of the property. <br /> Secondly, when a portion of our land was condemned for Autumn <br /> Woods, we lost- 1--wo catch basins that* G 1Gi•i our pdYiI• :y lot. <br /> . <br /> A third catch basin that drains the lot is on the Autumn <br /> Woods property. Already this spring that basin was not <br /> properly maintained and caused a major "lake" in our parking <br /> lot and when it finally drained, it left sand and gravel <br /> spread over the lot. To resolve this issue, we are asking <br /> the City to hire an independent licensed engineering firm. <br /> We ask that they study the current situation to determine if <br /> the existing catch basin is adequate to handle the run-off as <br /> the parking lot now exists. If it is, we need a permanent <br /> easement to drain the run off of our parking lot and the <br /> reassurance that the basin will be properly maintained to ' <br /> accept the run-off.
