Council with respect to any specific programs placed in operation or recommended <br /> by the Commissioner of Agriculture. <br /> 1215.04 Nuisances Declared. The following are public nuisances: <br /> (a) Any living or standing elm tree or part thereof infected with Dutch elm <br /> disease or which harbors the elm bark beetles causing the disease. <br /> (b) Stockpiling of bark bearing elm wood is permitted during'the period from <br /> September 15 through April 1. Any such wood not used by April 1 must be <br /> .removed and disposed of as provided in this Section. <br /> (c) Any living or standing oak tree or part thereof infected to any degree with <br /> Oak wilt disease. <br /> (d) Any living or standing tree infected with a disease recognized by the <br /> Commissioner of Agriculture as likely to be fatal and communicable to other <br /> trees. <br /> 1215.05 Abatement. It is unlawful for any person to permit any of the nuisances <br /> referred to in this Section to remain on any premises owned or controlled by the <br /> person. Any such nuisance may be abated in the manner provided in this Section. <br /> 1215.06 Inspection and Diagnosis. <br /> osis. <br /> Subd. 1 Inspection. The Manager or the Manager's designee will inspect <br /> property within the City as often as practicable to determine whether <br /> nuisances described in this Section exist. The Manager will investigate <br /> reported incidents of infestation by Dutch elm fungus or elm bark beetles and <br /> incidents of oak wilt. <br /> Subd. 2 Diagnosis. Upon finding tree disease conditions, the Manager may <br /> send specimens to the Commissioner of Agriculture for analysis, or take <br /> other steps for diagnosis as the Manager deems necessary or as may be <br /> recommended by the Commissioner. No action to remove infected trees or <br /> wood,may be taken until a reasonably positive diagnosis of the disease has <br /> been made. After diagnosis, the Manager will adopt a program of appropriate <br /> abatement procedures. The program_will be carried out in accordance with <br /> current technical and expert opinions and plans as may be designated by the <br /> Commissioner of Agriculture. <br /> Subd. 3 Abatement Plan. The Manager will provide for abatement of <br /> diseased trees on public property. In the case of diseased trees on private <br /> property, the Manager will notify the owner by mail.
