I REGULAR COUNCIL MEETING <br /> 0 MARCH 9, 1993 <br /> PAGE 5 <br /> 4 <br /> 5 <br /> 6 The City Manager stated that the permit approval will be <br /> 7 similar to a variance approval with the same requirements but <br /> 8 not requiring a hardship . <br /> 9 <br /> 10 Michael Baker , 3044 Croft Drive, stated he had spoken to the <br /> 11 City ' s Public Works Director regarding his concerns with the <br /> 12 effective date of this ordinance . He felt this may affect his <br /> 13 property and some construction he is considering. Typically, <br /> 14 an ordinance is not in effect until thirty days after its <br /> 15 passage . <br /> 16 <br /> 17 The City Manager noted that the third reading of the ordinance <br /> 18 should occur by the first week in May . He advised that <br /> 19 ordinances have traditionally been effective right after the <br /> 20 third reading . In this case, this would be April 13th . <br /> 21 <br /> 22 Motion by Wagner , second by Fleming to approve the first <br /> 23 reading of the Accessory Structure Setback Permit Ordinance . <br /> 24 <br /> 25 Motion carried unanimously <br /> 26 <br /> 2 . Redevelopment Plan - 3901/3909 Silver Lake Road <br /> 9 <br /> 30 Commissioner Gondorchin advised that there were very favorable <br /> 31 comments made by members of the Planning Commission regarding <br /> 32 this plan . A few questions were asked regarding berming and <br /> 33 foliage which were answered to the Commission' s satisfaction . <br /> 34 <br /> 35 The City Manager stated that there will be a public hearing <br /> 36 held on this plan on March 23rd . <br /> 37 <br /> 38 3 . Concept Review - 3901/3909 Silver Lake Road <br /> 39 <br /> 40 Four additional parking spaces are being requested for this <br /> 41 project . A variance would be required for these parking <br /> 42 spaces . It was noted that the spaces would also allow for less <br /> 43 visibility of the refuse/recycling area . <br /> 44. <br /> 45 Commissioner Gondorchin noted that three commissioners could <br /> 46 not support approval of granting of the variance in that there <br /> 47 was no demonstrated hardship . Two commissioners favored the <br /> 48 variance approval as it would afford better access to the <br /> 49 refuse/recycling bins . <br /> 50 <br /> • <br />
