City staff that a petitioner can revise a zoning request to a lower zoning level during the <br /> public hearing but can not go up to a higher zoning level. Changing a request to a higher <br /> zoning level would require another public hearing. • <br /> Approving the rezoning of this parcel of land for this project is appropriate for the <br /> following reasons: <br /> * Rezoning will allow for the redevelopment of these aging rental properties; <br /> Given the triangular configuration and the sloping topography, it will be too <br /> expensive to build single family homes on this property. In addition, an R-1 <br /> zoning is inappropriate because the property is directly across from industrial <br /> and commercial properties. This was an issue for the Mako, Inc. and Olson <br /> when they considered redeveloping this parcel last year. <br /> * The proposed townhouse project conforms to the concept of future land use <br /> for this area as seen on the land use map in the City's Comprehensive Plan. <br /> The map suggests that office buildings or townhouses are appropriate uses for <br /> this property. <br /> Townhouses will provide alternate living options for those people who do <br /> not want to live in a single family residence or who are looking for smaller <br /> homes. ' <br /> * This project will certainly protect or increase the property values of the <br /> surrounding homes. ' <br /> With minor adjustments to the site plan and plat map, Mr. Gregory's project meets all the <br /> height, area, density, front- and side-yard setbacks and parking requirements. He will <br /> require a variance for backyard setbacks, which will be addressed in a later public hearing. <br /> He is also petitioning the City for TIF assistance to defray demolition costs that estimated <br /> to be $30,000. <br /> RECOMMENDATION <br /> After reviewing the developer's revisions to this project, the Staff recommends the approval <br /> of the rezoning of this R-2 property to R-3, allowing for the construction of owner- <br /> occupied townhomes. Rezoning of this area to allow for the construction of this project <br /> appears to be an appropriate and best use for this land. <br />
