STAFF REPORT <br /> DATE: May 16, 1995 <br /> TO: Planning Commission Members <br /> FROM: Kim Moore-Sykes, Management Assistant <br /> ITEM: PETITION FOR VARIANCES -- ARNOLD GREGORY, <br /> ARNOLD DEVELOPMENT, THE ARBORS <br /> TOWNHOME PROJECT, OLD HIGHWAY 8 <br /> BACKGROUND <br /> Arnold Development originally submitted a petition for fronryard and backyard variances <br /> for the The Arbors townhome development. This property was originally 2938 Old <br /> Highway 8, 3004 Old Highway 8 and 2926/2930 Old Highway 8 and were known as the <br /> Mako Inc./Olson properties. Mr. Arnold Gregory, owner of Arnold Development, <br /> approached the City with a development plan for the area, whereby he would purchase the <br /> properties, demolish the existing structures; combine the three parcels and construct 18 <br /> owner-occupied townhomes on the site. <br /> He is P urchasing these three parcels and is proposing to build two 3-unit buildings and <br /> three 4-unit buildings. Because of the City's zoning ordinance, Mr. Gregory is required to <br /> rezone this parcel to R-3 in order to proceed with his redevelopment plans. The property <br /> is 74,250 square feet and will allow for the construction of five townhome buildings. <br /> On the original plat submitted initially, the variance request was for a frontyard variance as <br /> well. Due to the reconfiguration as the result of a change in the rezoning request, Mr. <br /> Gregory and his architect, Mr. Mazzara were able to eliminate the need for the frontyard <br /> variance for this project. The project meets all of the frontyard and sideyard setbacks, . <br /> parking requirments, density and area/width requirements. <br /> Mr Gregory is requesting that he be granted a 10 foot variance to the backyard setback of <br /> the townhome development. Under the R-3 zoning ordinance he needs a 30 foot backyard <br /> setback. Due to the shape and the topographical conditions of the parcel, he is unable to <br /> attain the backyard setback requirement. This 10 foot variance is required for Lots 1 <br /> through 8. The request for backyard variances range from an 10 foot variance for Lots 1, <br /> 2, 5 and 6 to a 2 foot variance for Lots 7 and 8. <br />
