Licensed Daycare centers <br /> C. Residential properties — <br /> R-1, R-2, PRD, PSR, or MDD zoning districts. <br /> The City of Ramsey was forced to deal with this issue as the result of a legal challenge to <br /> their issuance of a moratorium on sexually oriented business. The courts determined that <br /> the City's placing a moratorium violated the constitutional rights of the owner of a <br /> sexually oriented because the moratorium limited his freedom of speech. The City of <br /> Ramsey was required to pay back lost income to the business owner. <br /> They retained a consultant at that point to help draft an di buseiness anould protect <br /> community from the secondary adverse effects of an adul <br /> business in question to operate in a regulated manner. The following suggests were <br /> reported to the City Council: <br /> 1. Establish a commercial zoning district for adult use/sexually oriented <br /> businesses. <br /> 2. Adult use/sexually oriented businesses should be separated from: <br /> a. residential zoned districts <br /> b. schools <br /> c. daycare centers <br /> d. libraries <br /> e. parks/recreational areas <br /> f. on-sale liquor businesses <br /> 9- churches <br /> h. other adult use/sexually oriented businesses <br /> The recommended distance was at least 750 feet. The City Council ultimately <br /> adopted a distance of 1000 feet. <br /> 3. The ordinance adopted restricts adult use/sexually oriented business to one <br /> "product" per location. For example, one store can only stock <br /> books/magazines. Another can only have as-inventory videos/movies. <br /> The attached is a copy of the proposed draft of the ordinance that would amend Chapter <br /> 16 of St. Anthony's 1993 Code of Ordinances. It establishes that only the commercial <br /> zoning district will be available for the location of adult use and sexually oriented <br /> _ businesses and these kinds of businesses can not be closer than 400 feet to residential zoned <br />
