Osterbauer, D.D.S. <br /> • 3525 33rd Avenue N.E. <br /> Dear Mike: <br /> You have provided me with information regarding a sign identifying the <br /> dental office of Dr. Joseph Osterbauer. As Y understand it, the sign is to replace a sign <br /> which was previously located at tlus property. <br /> Since this is a service office use in a residential district, it is a nonconforming <br /> use, and you have asked whether this sign would constitute an expansion of that <br /> nonconforming use. <br /> The .provisions of the City zoning ordinances regarding nonconforming uses <br /> are found in Section 1660. Under this Section, nonconforming uses are not <br /> permitted to be enlarged, expanded or extended. Clearly, if Dr. Osterbauer wanted to <br /> put arL addition onto the office, or to include another dentist in the clinic, or <br /> otherwise enlarge the dental office use, that would not be permitted. The question <br /> then is whether the sign constitutes an expansion. Under Subdivision 1 of Section <br /> 1660.02, "No structure used for a nonconforming use may be enlarged, extended, <br /> reconstructed, replaced or moved except to change it to a conforming use." In my <br /> opinion, adding the sign does not enlarge or extend the "structure". <br /> • Under Subdivision 2 of Section 1660.02, "No nonconforming use may be <br /> extended to occupy any additional land outside any buildings in which the <br />
