ANTHONY 02 REGULAR CITY COUNCIL MEETING 3 DECEMBER 16, 1998 4 I. CALL TO ORDER. 5 The meeting was called to order at 7:25 P.M. 6 II. ROLL CALL. 7 Councilmembers present: Ranallo, Marks, Faust, Cavanaugh, and Thuesen. 8 Councilmembers absent: None. 9 Also.present: City Manager Mike Mornson. 10 III. APPROVAL OF DECEMBER 16, 1998 REGULAR COUNCIL MEETING AGENDA. 11 Motion by Marks, second by Thuesen to approve the December 16, 1998 Regular City Council 12 Meeting Agenda as presented. 13 14 Motion carried unanimously. 15 IV. APPROVAL OF DECEMBER 7, 1998 REGULAR CITY COUNCIL MEETING 0 6 MINUTES. 7 Motion by Marks, second by Faust to approve the December 7, 1998 Regular City Council 18 Meeting Minutes as presented. 19 Motion carried unanimously. 20 21 V. LICENSES/PERMITS/PETITIONS -None. 22 VI. PRESENTATION OF CLAIMS. 23 Motion by Marks, second by Faust to approve the following claims: 24 A. Road Improvements: 25 1. Northdale Construction in the amount of$14,773.18 for Payment Application No. 26 5 (Final) 1977 Watermain, Street and Storm Sewer Improvements, RCM Project 27 No. 10366.03 28 -- - B. 2 pages of Verified Claims as presented by the Finance Director. 29 Motion carried unanimously. 30 VII. REPORTS. 0 33 1 A. Park Commission Report-December 14, 1998 2 Joanne Kosciolek, Park Commissioner,reported they met on December 14, 1998 with Todd Hubmer who provided an update on Silver Point Park and informed of the construction review 34 information which is available at City Hall. This information will also be sent to the Council, City Council Meeting Minutes December 16, 1998 Page 2 1 Park Commission members, and area residents effected by this project. She advised that the 2 project had fallen a little behind but is now.back on schedule. Ms. Kosciolek stated they have 3 had minimal complaints from area residents and hope that will continue. 4 In addition, a subcommittee was established to work on the playground equipment for the park 5 near the water tower. That subcommittee has met several times, is developing a"wish list" on 6 the types of equipment desired, and is now waiting for the results of the physical survey. After 7 that, information will be sent to vendors to obtain bids and layout of equipment. Ms. Kosciolek 8 stated they are looking at multi-generational equipment that all can use. She advised that they 9 now have an on-going agenda item to allow for reports from the sports boosters, school board, 10 and community services. 11 Thuesen asked if they have looked at the option of applying for grants or fund raising activities. 12 Ms. Kosciolek stated they have not yet done so but after meeting with the vendors they will have 13 a better idea of the costs involved. 14 Thuesen asked if grants are available for this type of playground equipment purchase. Ms. 15 Kosciolek stated she is not aware of any. She added they have a budget of about$40,000. 16 Mr. Morrison stated that$40,000 is budgeted for the Silver Point project but a specific budget ' 17 has not been established for the water tower park. 18 Ranallo advised that$250,000 was set aside for park improvements last year and the 1999 19 Budget contains funds for park improvements again this year. A specific budget has not yet been 20 established for that park because it is not yet known what type of equipment is needed. 21 Faust suggested the needs be looked at first,then the equipment for those needs be identified, 22 costs gathered, and then the budget can be determined. 23 Cavanaugh stated that once the plan is designed which is believed to best fit the community's 24 needs, the money needed can be discussed. 25 Ranallo stated that at one time he had made the recommendation that anything above the $65,000 26 taken from the Liquor stores could be transferred to the parks. 27 Marks stated that a task force looked at this, developed three different choices, and then the most 28 appropriate layout was determined. He stated that he believes the appropriate method is to first 29 identify the needs and then develop a budget. He stated that fund raising in the City is a good 30 and viable option because it allows all to aid the development of the parks and pulls everyone 31 into the park project. City Council Meeting Minutes December 16, 1998 Page 3 1 Ranallo extended this appreciation and that of the Council to the Park Commission for the work 2 they are doing. 3 B. Councilmembers. 4 Thuesen stated he attended the public forum with the St. Anthony Chemical Health Coalition on 5 alcohol and drugs and does not know what a realistic turnout should have been but was a bit 6 disappointed there was only 60 in attendance. He stated that there was good dialogue with the 7 adult and student focus groups and good information was brought out. Thuesen stated he hopes 8 they take that information to the next appropriate step and move forward. 9 Ranallo reported that today he attended the Middle School Student Council meeting which was 10 attended by about 20 students. He stated that he asked these students what the City is not doing 11 for students that they should be doing. One person wanted a center where young people can go.- 12 He stated he mentioned the Community Center and explained the past problems with the other 13 community centers. The student indicated they want someplace that is not near the school or 14 City Hall but,maybe, in the shopping center and run by the City. He advised that the students 15 will come back to the Council with additional suggestions. Ranallo suggested the City look at 16 the option of providing such a place for the City's young people. He asked Ms. Kosciolek to take this information back to the Park Committee. 18 Faust stated he also attended this Coalition meeting which he found very interesting. He noted 19 that kids always talk about being bored and someone suggested they survey the students. He 20 stated he talked with the superintendent after the meeting and requested a copy of that survey to 21 see what youth want. Faust commented on the importance of obtaining feedback from the school 22 which can be considered and relayed to the Park Committee for their review and 23 recommendation. 24 Faust stated there was a lot of good energetic inter-generational dialog at the Coalition meeting. 25 He reported that another issue raised'was the need for a place where youth can go to socialize. 26 The youth at the meeting had commented that at Perkins they just need to order fries and pop and 27 they can stay all night. Faust noted that an option would be for the City to provide seed money 28 for such a place which could also teach the economics of a business which would be a valuable 29 lesson for the City's youth. He stated the Coalition meeting was a good step and with three St. 30 Anthony Councilmembers present at the meting, it was a good show of support. 31 Marks announced that people are still joining the Sister City organization and invited all to 32 contact him if they are interested in joining. 33 Cavanaugh stated he also attended the St. Anthony Chemical Health Coalition and saw 60 4 people who would not have been there if not for the Coalition. He stated there was a lot of 5 discussion and Police Chief Engstrom made an excellent presentation. Principals and coaches 36 were in attendance, discussions took place, and misconceptions of discipline of athletes was City Council Meeting Minutes December 16, 1998 Page 4 1 discussed. Cavanaugh stated the meeting was a first attempt and as such was a very good one. 2 He stated the issue of a teen center is on the task force agenda and there was discussion if it 3 would be possible to privatize a center for the teens. Another issue raised was how to utilize the 4 Community Center to which he responded it is probably too small for some events the 5 community may want and the City may consider in the future the option of expanding the 6 Community Center. He stated there will be meetings after the first of the year and, hopefully, the 7 momentum will remain. Cavanaugh stated the Police Chief also discussed tobacco and alcohol 8 checks which was a good discussion. He stated his impression that the 60 who attended were 9 very interested and left charged up about those issues. 10 C. Mayor. 11 Ranallo asked that certificates of appreciation be ordered for Planning Commissioners Wagner 12 and Thompson who will be leaving the Planning Commission and to schedule a presentation 13 before the Council. 14 15 D. City Manager. 16 Mornson noted that the bid opening was December 10, 1998 and Northdale Construction was the 17 apparent low bidder. These bids will be presented to the Council and the public hearing set for 18 that project. 19 Mornson reported on the meeting he attended with the DNR and Division of Waters who assisted 20 the City in getting the $2 million. He stated the City staff laid out some very convincing 21 arguments for additional funding due to the contamination that was discovered and the.need to 22 resolve"those issues. He stated that the conclusion is that it will be a larger challenge to get 23 funding this year than last year. Mornson stated that Senator Langseth, Chair of the Senate 24 Committee, is still the Chair and a bill was passed last year that there would be flood relief 25 available but the level will not be determined until the 1999 session. The DNR suggested the 26 City draft a plan on when the money will be needed and how much will be needed. In the mean 27 time, he notified John Marty and will provide that information to the Mayor and Council. 28 Mornson welcomed their help on this issue. 29 Cavanaugh inquired regarding the level of the past and current funding request. Mr. Mornson 30 reviewed the amounts requested and work that was accomplished. He advised that the DNR 31 understood the need for more funding to address the contamination and indicated that they are 32 receiving similar requests from other communities. 33 Mornson reported that Ramsey County has scheduled a.stop light for the year 2000 for the 34 intersection of Highcrest and 37th Avenue. 35 Mornson reported the schedule for the Board of Review on April 6, 1999 and asked the Council 36 when they would like to start that meeting. He advised that in the past it has started before the City Council Meeting Minutes December 16, 1998 Page 5 1 work session.and asked if that would be acceptable again this year. The Council indicated it 2 would be acceptable. The Board of Review will start at 6:30 PM. 3 Morrison advised that the efforts of,the St. Anthony Fire Department for the Toys for Tots 4 program and Santa on the truck and will be recognized and broadcast on a television newscast. 5 Morrison commented on the positive impact of the profits in the liquor store and indicated he 6 wants to give credit for the decision on the new store to the Council decision of two years ago 7 and to the Liquor Operations Manager. He stated the Liquor Operations Manager, Mike Larson, 8 has reported that receipts are on pace to make a profit which has not been seen since 1990 and 9 1991. Also,the Liquor Operations Manager feels this is only the "tip" of what can be realized. 10 Cavanaugh commented on former liquor store employee, Mike Smith, going to the Stone House. 11 He indicated that Mr. Smith was one of the finest wine salesman and is quite a loss. 12 Mornson advised that Mr. Smith is going to become the manager of the Stone House and he 13 believes Mr. Smith will do a good job. The current Stone House manage will,be retiring and 14 Morrison stated he and Mike Larson felt this would be another way to save the City money and actually make more money for the City. 16 Thuesen stated that he has every confidence that Mr. Smith will do well in that position and it 17 will prove to be a good move. 18 Thuesen asked if it was two seasons ago that Northdale Construction had the bid and if there 19 were any problems with them. Morrison stated they did the 1997 project and the City had a good 20 experience with them. 21 Cavanaugh asked if the $900,000 for the streets will come from the State money. Morrison 22 stated that the public hearing on the special assessments will be held at the February meeting and 23 then Springsted will present a resolution authorizing them to do a public bid on the bond with the 24 bond award in March of 1999. He noted that the State money covers the work on the storm 25 water issues. 26 -- Cavanaugh raised the issue of Y2K(Year 2000 compliance) and suggested discussions on that 27 issue occur at the January work session. He commented on a recent article which identified the 28 importance of involving the community in what is being done,to provide assurances to them, 29 and to resolve any fears that are present. 30 Ranallo stated the task has been assigned to Kim Moore-Sykes to attend the meeting and then 1 verse,the Council on information gathered. City Council Meeting Minutes December 16, 1998 Page 6 - 1 Mornson stated he would like to schedule that topic for the February work session which is 2 typically a light session. 3 Faust suggested the Council talk exclusively about Y2K at that workshop and that the 4 department heads be present. Faust stated that involvement of residents would follow based on a 5 plan that is devised by the Council. 6 Momson stated they will also publish articles on this topic in the City's newsletter. 7 Ranallo commented on the importance of becoming knowledgeable with Y2K issues and 8 meeting with knowledgeable people so they can attend the meeting and answer questions that are 9 raised. 10 11 VIII. PUBLIC HEARINGS -None. 12 IX. NEW BUSINESS. 13 A. Appoint Planning Commissioners. 14 Ranallo noted that both Todd J. Hanson and Randy Stille were interviewed prior to the meeting 15 tonight and there are two openings on the Planning Commission. 16 Motion by Marks, second by Cavanaugh to appoint Todd J. Hanson, 3721 Foss Road, and Randy 17 Stille, 3117 Rankin Road NE, to the Planning Commission for full three-year terms. 18 Ranallo commented that these are two excellent candidates that will bring new views to the 19 Planning Commission. 20 Motion carried unanimously. 21 B. Resolution 98-083,re: City Manager's 1999 salary. 22 Motion by Faust, second by Marks to adopt Resolution 98-083, approving 1999 salary of 23 Michael J. Morrison, St. Anthony City Manager. 24 Cavanaugh noted the format established for evaluating the City Manager and stated his support 25 for the format suggested by Faust since it allows a measurement against something specific. He 26 commented that Thuesen worked hard on that process and he believes a process that is consistent 27 needs to be considered. 28 Faust suggested that the Council come up with a format that is standardized. 29 Thuesen stated that he supports a process,which will allow the ability to review issues such as. 30 performance. He stated the Council needs to discuss their objectives and areas they feel are 31 important. He suggested it be further discussed.at the retreat. City Council Meeting Minutes December 16, 1998 Page 7 1 Marks stated he had obtained information from the League of Minnesota Municipalities on how 2 other cities conduct City Manager reviews. Report from the Parks Commission: _ Commissioner Wagner presented the Parks Commission report. He reported that Todd Hubmer, WSB, provided a progress report on the Silver Point Park project. He indicated that the excavation should be.done by the end of this week and the pipe installation should be completed by the end of the month. Wagner reported that Hubmer indicated that if the weather holds, excavation could begin at Central Park in the NE corner of the Park. Hubmer indicated that they may be able to use this dirt at Silver Point Park for the base of the parking lot. Wagner also reported that the Parks Commission will be discussing landscaping plans, platting of Water Tower Park and planning playground equipment for Water Tower Park. He said that the residents adjacent to the parks where working is being done are getting construction reports similar to those that are distributed during the street reconstruction projects. Wagner reported that the extra drive-cut into Silver Point Park from Hwy. 88 is temporary and was done to facilitate the safer flow of trucks into and out of the Park. 5. Proposed Erosion Control/Storm Water Management Ordinance. The Commissioners discussed proposed changes to the language of the proposed Storm Water Management. Those changes will be more fully noted in the Planning Commission minutes. Essentially, they changed the wording of the "Lawn Fertilizer Education" portion of the proposed ordinance so that it reads, "Lawn Maintenance Education". They also asked if the acreage of residential and commercial that are covered by this proposed ordinance was an arbitrarily set figure. Many were concerned that storm water plans may be costly for the smaller construction projects that an homeowner or small business may want to have done. 6. Discussion of Goals for 1999. General discussion of what the Planning Commission should deal with in 1999. Wagner suggested being pro-active on a number of • redevelopment projects that the City or will be involved with. Gondorchin concurred. Since this was a topic that Chair Bergstrom initiated at the last Planning Commission meeting and he was not able to attend tonight's meeting, further discussion was deferred to the January meeting. Planning Commission Meeting Minutes December 15, 1998 Page 2 1 Wagner reviewed the Parks Commission's December 14, 1998 meeting at which Todd Hubmer, 2 WSB, reviewed the Silver Point Park excavation project. He added the Commission discussed 3 the $40,000 figure budgeted for playground equipment in the park and whether equipment 4 installation was included in that figure. Mr. Hubmer agreed to determine whether installation 5 was provided by the manufacturer. 6 7 Wagner stated park excavation will be completed by the end of this week with pipework 8 completed by the end of the month. He added.park restoration, including seeding, sodding, trail 9 configuration and playground equipment installation,will be completed in April or May 1999. 10 11 Wagner stated the excavation has progressed well due to the mild weather, and the contractor 12 hopes to begin digging a retention pond in the northeast corner of Central Park rather than wait 13 until Spring 1999. 14 15 Wagner stated Mr. Hubmer indicated a landscaping plan will be ready for review by the Parks 16 Commission at their January 11, 1999 meeting, as well as a plan for the Water,Tower Park area. 17 He added no Sports Boosters representative was present at the meeting, and there was some 18 discussion with regard to the Sports Boosters and their role in parks planning as some changes 19 had been made in Central Park without the Commission's knowledge. 20 21 Wagner stated the Commission hopes'to order'playground equipment for both Silver Point and 22 Central Parks simultaneously. He added the target date for completion of Water Tower Park is 23 July 1, 1999. 24 25 Wagner stated a copy of a bi-weekly Construction Update had been presented to the Commission 26 which reviews the excavation project and gives information about the contractor. He added this 27 update is being mailed to residents. 28 29 Makowske asked whether any other issues or complaints with regard to the excavation had been 30 raised by residents. Wagner stated no major complaints had been received,with the exception of - 3.1 an issue involving a temporary exit from the park to allow excavation trucks to have northbound 32 access to Highway 88. 33 2. Review Comments Re: Proposed Erosion Control/Storm Water Management Ordinance. 34 Makowske stated the City Council had delayed the 2nd reading of the proposed Erosion 35 Control/Storm Water Management Ordinance until their January 12, 1999 meeting. He added 36 the Council has requested further comments on the ordinance from the Commission, and opened 37 the discussion. 38 39 Wagner drew the Commission's attention to Section 1675.08, Subd. 17 which addresses the issue 40 of lawn fertilizer education. He added this was a new entry,the addition of which was resultant 41 from the Commission's recent related discussions. He added he believes the ordinance should be Planning Commission Meeting Minutes December 15, 1998 Page 3 1 broadly based and should require the'City to do more to educate residents on reasons for not 2 using phosphorus. 3 . 4 Wagner stated he believes the section should include a statement to the effect that other 5 educational opportunities will be on-going, suggesting the City's efforts are not limited to a 6 quarterly newsletter article. 7 8 Gondorchin stated he believes the section should reflect that it is not simply fertilizer which is 9 the source of the problem, but more accurately, improperly applied fertilizer. He added the 10 greatest impact to lakes is lawn clippings which are washed into the streets and sewers. Horst 11 agreed that misuse of yard debris should be addressed. 12 13 Horst stated he believes there is not sufficient need for this section, and whether or not the City 14 supports on-going education, the implication should not be that phosphorus is bad. He added the 15 section implies the City is not considering both sides of the issue, and the section should be 16 stricken from the ordinance. He reiterated the City should work towards education, and support 17 residents who feel this is a critical issue, but it should not be the law of the City. 18 9 Gondorchin agreed, stating specific comments could be inserted which specify to what extent the application of fertilizer is improper. He added further.discussion with the Council is necessary. 1 ' 22 Makowske asked whether Horst recommends the elimination of the subdivision. Horst stated the 23 section could be amended to stress lawn debri s education. Makowske asked whether the City 24 should still publish a quarterly newsletter article. Gondorchin stated he believes the section 25 should be amended to reflect that the City will sponsor and distribute lawn care information as 26 applicable. He added, more specifically,residents should be made aware that the greatest impact 27 they can have is to ensure clippings do not fall into storm drainage or natural drainage areas. 28 29 Gondorchin drew the Commission's attention to Section 1675.05, Subd.1, asking whether it is 30 necessary to apply this to small developments, based on the cost impact to developers of under 3 31 acres of land. 32 33 Horst expressed his agreement, stating a 3-acre development site would eliminate smaller home 34 sites. He cited as an example the development of Northgate which is not 10 acres but is over 3 35 acres, adding it would be necessary for a potential developer to complete an impact study. 36 37 Gondorchin asked whether the subdivision relates strictly to commercial and high density 38 development, and asked for clarification with regard to the basis for selecting the limitation of 3 39 acres. Ms. Moore-Sykes stated these limitations were included in the Metropolitan Council's 40 proposed ordinance. 1 3. Planning Commission Applicants' Letters of Interest. Planning Commission Meeting Minutes December 15, 1998 Page 4 1 Ms. Moore-Sykes stated two letters of.application had been received for the Commission's two 2 openings, and the candidates would-be interviewed by the City Council at 6:30 P.M. on 3 December.16, 1998 for.approval at their regular meeting that night. She invited the 4 Commissioners to attend'if interested. 5 6 4. Discussion of Goals for 1999. 7 Makowske stated a request had been made of the Commission by Bergstrom to consider 8 priorities for the Commission in 1999, and he opened the discussion. 9 10 Gondorchin stated the Commission might want to wait until its two newly elected members are 11 in attendance, and also to regenerate the previous list of priorities for the Commission's review. 12 13 Wagner stated with his temporary commission coming to an end he would not be involved in 14 1999's goals,but he reviewed some suggestions for the Commission. He cited three main areas 15 for the Commission's focus which will likely come to the forefront in 1999: the Salvation Army 16 camp property; Apache Plaza; and St. Anthony Shopping Center. He added the Commission 17 must establish its priorities before determinations are made and finalized. 18 19 Wagner stated the City Manager will be the first point of contact at the City for developers, and it 20 will be important for the Commission to be proactive in making their wishes known to him. He 21 added he would wish the Salvation Army camp property to be developed into a corporate campus 22 setting with a portion preserved for parkland. 23 24 Gondorchin expressed his agreement with regard to the importance of the Salvation Army camp 25 property, adding its zoning will be a crucial factor. He stated contingencies must be made for 26 property, in the south end of the City which has been recently acquired. He added he would wish 27 the City to generate some support from developers with regard to Apache Plaza, and make them 28 aware that the City will be proactive in its development of the property to include incorporation 29 of the railroad properties to create a unique site. 30 31 Gondorchin stated the City must create an identity and become aggressive in its approach toward 32 attracting residents and developers. He added the City must invigorate and enforce housing code.. 33 regulations. 34 35 Gondorchin stated parks issues are important to citizens and the Commission must keep parks 36 development at the forefront of their agenda for 1999. He added some form of cosmetic 37 improvement was necessary on 37th Avenue which might be tied in with the redevelopment of 38 Apache. 39 40 Gondorchin stated he would wish the Commission to create guidelines with regard to natural 41 habitat on personal property: kinds and varieties, and height regulations. 42 Planning Commission Meeting Minutes December 15, 1998 Page 5 1 Gondorchin stated the issue of rv's and trailors parked on personal property is an important one 2 to residents and the Commission should consider a tougher regulatory policy. 3 4 Gondorchin stated he would wish the issue of split liquor be revisited by the Commission in 5 1999 to determine issues, obstacles,benefits and risks. 6 7 Makowske stressed the importance of industrial, commercial and retail planning for three 8 different aspects of the City: 1) large commercial properties such as the industrial park, Apache 9 Plaza and St. Anthony Shopping Center; 2) smaller businesses and home businesses; and 3) 10 amenities and incentives. 11 12 Thompson recommended the Commission consider landscaping, lighting, and amenities with 13 regard to the Silver Lake Road bridge project to enhance the area and promote the further 14 development of Apache Plaza. 15 IX. COMMENTS. 16 Makowske thanked Wagner and Thompson for their service on the Commission. Wagner 17 expressed his pleasure at serving on the Commission, adding he will continue to reside in the toCity, and will be interested in the further development of the Village. Kaczor asked for an update on the possible theater at Apache Plaza. Ms. Moore-Sykes stated a 21 letter was received by City Manager Mike Mornson from the developers reiterating their strong 22 interest in the site. She added more information will be available after the start of the new year, 23 and there is no news on Herberger's. 24 25 Kaczor expressed his gratitude to Wagner and Thompson for their participation on the 26 Commission. He added a comment from his 9th grade daughter with regard to Apache Plaza's 27 development, expressing a general consensus among teenagers who would wish to see some 28 form of entertainment made accessible to that age group in the City. 29 30 Wagner stated he enjoyed his time with the Commission, and added he appreciated the 31 opportunity to serve. 32 33 Ms. Moore-Sykes stated the first order of business at the Commission's January 12, 1999 34 meeting will be the election of a chair and vice-chair. 35 36 Ms. Moore-Sykes stated City Councilmember Faust expressed an interest in creating a Council 37 liaison to the Commission, and if no objections were raised by the Commissioners he would be 38 in attendance at their January 12, 1999 meeting. The process is done to assure that: 1) our present provider (Firstar St. Anthony Bank) remains competitive in the market place.and 2) new marketing and industry trends for banking services are periodically reviewed. Currently, all of the City's checking accounts are on a "waived fee" status. On the surface one could assume that the City is receiving free checking. However, this assumption would be incorrect. ANTHONY RESOLUTION 99-014 A RESOLUTION DECLARING COST TO BE ASSESSED AND ORDERING PREPARATION OF PROPOSED ASSESSMENT WHEREAS, costs have been determined for the improvement of(1)Wilson Street, 27'Avenue NE to 29`h Avenue NE; (2) Pahl Avenue, Wilson Street to Coolidge Street; (3) Alley: Wilson Street to Coolidge Street (south of Murray Avenue); (4) Alley: Wilson Street to Coolidge Street (south of Pahl Avenue); and, (5) Alley, Wilson Street to Coolidge Street (south of St. Anthony Boulevard) and the bid price for such improvement is $886,231.71, and the total cost of the improvement will be approximately $1,130,000. Commission Members FROM: Michael Mornson, City Manager ITEM: STORM WATER MANAGEMENT ORDINANCE The City Council is continuing to review the Storm Water Management ordinance because several concerns about the ordinance as proposed have come to light. The Council would like the Planning Commission to review the ordinance, with suggested changes, at their December 15, 1998 meeting. The Council will continue to review the ordinance at their January 5 Work Session. The Council will then hold the second reading at their January 12, 1999 meeting and the third reading at their January 26, 1999 meeting. Following are the changes: • Section 1675.05, Subd. 1 The first sentence will read as follows: "Every applicant for a building permit, subdivision approval, or a permit in the Commercial, Industrial, R-3 and R-4 Zoning Districts of the City must submit a Storm Water Management Plan to the Public Works Director.", deleting "which disturbs three or more acres of land or for projects required by the public Works Director which disturb less than three acres of land". Section 1675.05, Subd. 2 Delete "(a)" Section 1675.05, Subd. 2 Change (b) to (a); (c) to (b); (d) to (c) and delete ..."before the effective date of this Section."; and, (e) to (d) and delete ...."only"...., and add ..."when it is over one acre in size." Section 1675.08, Subd. 6 (c) (2) Delete "10" and replace with "3" .... Section 1675.08, Subd. 6 (d) Delete "Any soil or dirt storage piles containing more than 10 cubic yards of material should not be located with a downslope drainage length of less than 25 feet from the toe • of the pile to a roadway drainage channel." Page 2 • Section 1675.08 Add Subd. 17 "Subd. 17. Lawn Maintenance Education. The City shall participate in on-going educational opportunities to inform the residents of the harmful impacts to the environment by doing any of the following: Improperly applying fertilizer; leaving or depositing grass clippings, leaves, etc. in any storm drainage area, street or natural drainage area; and, in addition, to discuss the benefits of using fertilizer containing less than three percent by weight of phosphorus." • CITY OF ST. ANTHONY ORDINANCE 1998-010 AN ORDINANCE RELATED TO STORM WATER MANAGEMENT; AMENDING CHAPTER 16 OF THE CITY CODE BY ADOPTING A NEW SECTION The City Council of the City of St. Anthony hereby ordains: Section 1. Chapter 16,Zoning and Land Use, is amended by adding a new Section 1675 to read as follows: SECTION 1675 - STORM WATER MANAGEMENT 1675.01 Statutory Authorization. This Section is adopted pursuant to Minnesota Statutes Sections_462.351 through 462.365. 1675.02 Findings. The City hereby finds that uncontrolled and inadequately planned use of wetlands, woodlands, natural habitat areas, areas subject to soil erosion and areas containing restrictive soils, adversely affects the public health, safety and general welfare by impacting water quality and contributing to other environmental problems, creating nuisances, impairing other beneficial uses of environmental resources and hindering the ability of the City to provide adequate water, sewage, flood control, and other services. 1675.03 Purpose. The purpose of this Section is to address the findings in Section 1675.02 and to promote,preserve and enhance the natural resources within the City. 1675.04 Definitions. For the purposes of this Section,the following terms, phrases, words, and their derivatives shall have the meanings stated below. Applican t. Any person who wishes to obtain a building permit, zoning or subdivision approval. Control measure. A practice or combination of practices to control erosion and attendant pollution. Detention facility. A permanent natural or man-made structure, including wetlands, for the temporary'storage of runoff which contains a permanent pool of water. Flood fringe. The portion of the flood plain outside of the flood way. Flood plain. The areas adjoining a watercourse or water basin that have been or may be covered by a regional flood. Flood way. The channel of the watercourse,the bed of water basins, and those portions of the adjoining flood plains that are reasonably required to carry and discharge flood water and provide water storage during a regional flood. Hydric soils. Soils that are saturated,flooded, or ponded long enough during the growing season to develop anaerobic conditions in the upper part. Hvdroph is vegetation. Macrophytic plant life growing in water, soil or on a substrate that is at least periodically deficient in oxygen as a result of excessive water content. Land disturbing or development activities. Any change of the land surface including removing vegetative cover, excavating, filling, grading, and the construction of any structure. Person. Any individual, firm, corporation,partnership, franchisee, association, or Plan. A storm water management plan governed by this Section. Public waters. Waters of the state as defined in Minnesota Statutes Section 103G.005, subdivision 15. Regional flood. A flood that is representative of large floods known to have occurred generally in the state and reasonably characteristic of what can be expected to occur on an average frequency in the magnitude of a 100-year recurrence interval. Retention_facili1y. A permanent natural or man made structure that provides for the storage of storm water runoff by means of a permanent pool of water. Sediment. Solid matter carried by water; sewage, or other liquids. Structure. Anything manufactured, constructed or erected which is normally attached to or positioned on land, including portable structures, earthen structures, roads,parking lots, and paved storage areas. This Section. This Section 1675. between terrestrial and aquatic systems where the water Wetlands. Lands transitional q y table is usually at or near the surface or the land is covered by shallow water. For purposes of this definition, wetlands must have the following three attributes: (a) have a predominance of.hydric soils; -2- (b) are inundated or saturated by surface or ground water at a frequency and duration sufficient to support a prevalence of hydrophytic vegetation typically adapted for life in saturated soil conditions; and (c) under normal circumstances support a prevalence of such vegetation. 1675.05 Scope and Effect. Subd. 1 kpplicability. Every applicant for a building permit, subdivision approval, or a permit in the Commercial,Industrial, R-3 and R-4 Zoning Districts of the City must- submit a Storm Water Management Plan to the Public Works Director. No building permit, subdivision approval, or permit to allow land disturbing activities shall be issued until approval of the plan or a waiver of the approval requirement has been obtained under this Section. Subd. 2 Exemptions. The provisions of this Section do not apply to fences, sign or poles or emergency work, or to the following items if approved before the effective date of this Section: (a) Any part of a subdivision approved by the City Council before the effective date of this Section. (b) Any land disturbing activity for which plans have been approved by the watershed management organization. (c) A lot for which a building permit has been approved. (d) Building permits issued in the R-1, R-lA, or R-2 Zoning District. In these Districts,the property owner must obtain prior approval from-o*the Director of Public Works of a storm water plan appropriate in scale and scope to the proposed activity when it is over one acre in size. 1675.06 Plan Approval Procedures. Subd. 1 Application. Any plan and an application for its approval shall be filed with the Public Works Director. It must state the grounds for approval, that the proposed use is permitted by the zoning ordinances, and adequate evidence that the proposed use will conform to this Section. Prior to applying, an applicant may have the plan reviewed by the appropriate departments of the City. The applicant must submit two sets of clearly legible blue or black lined drawings in appropriate scale (not less than 1 inch equals 100 feet)and the required additional information with evidence of payment of all fees required under Section 1675.07. -3- Subd. 2 Plan. At a minimum, the plan shall contain the following information. (a) Existing site map. A map of existing site conditions showing the site and immediately adjacent areas, including: (1) The name and address of the applicant, the section, township and range,. north point,date and scale of drawing and number of sheets. (2) Location of the tract by an insert map at a scale sufficient to clearly, identify the location of the property and giving such information as the names and numbers of adjoining roads,railroads, utilities, subdivisions, towns and districts or other landmarks. (3) Existing topography with a contour interval appropriate to the topography of the land but in no case having a contour interval greater than 2 feet. (4) A delineation of all streams, rivers,public waters and wetlands located on and immediately adjacent to the site. (5) Location and dimensions of existing storm water drainage systems and natural drainage patterns on and immediately adjacent to the site delineating in which direction and at what rate storm water is conveyed from the site, identifying the receiving stream,river,public water, or wetland, and setting forth those areas of the unaltered site where storm water collects. (6) A description of the soils of the site, including a map indicating soil types of areas to be disturbed as well as a soil report containing information on the suitability of the soils for the type of development proposed. (7) Vegetative cover and clearly delineating any vegetation proposed for removal. (8) 100 year flood plains, flood fringes and flood ways. (b) Site construction plan. A site construction plan,.including: (1) Locations and dimensions of all proposed land disturbing activities and any phasing of those activities. (2) Locations and dimensions of all temporary soil or dirt stockpiles. -4- (3) Locations and dimensions of all construction site erosion control measures necessary to meet the requirements of this Section. (4) Schedule of anticipated starting and completion date of each land disturbing activity including the installation o£construction site erosion control measures needed to meet the requirements of this Section. (5) Provisions for maintenance of the construction site erosion control measures during construction. (c) Drawing of final site conditions. A drawing of final site conditions on the same scale as the existing site map showing the site changes including: (1) Finished grading shown at contours at the same interval as provided above or as required to clearly indicate the relationship of proposed changes to existing topography and remaining features. (2) A landscape plan, drawn to an appropriate scale, including dimensions and distances and the location,type, size and description of all proposed landscape materials which will be added to the site as part of the development. (3) A drainage plan of the developed site delineating in which direction and at what rate storm water will be conveyed from the site and setting forth the areas of the site where storm water will be allowed to collect. (4) The proposed size, alignment and intended use of any structures to be erected on the site. (5) A clear delineation and tabulation of all areas which shall.be paved or surfaced, including a description of the surfacing material to be used. (6) Any other information pertinent to the particular project which in the opinion of the applicant is necessary for the review of the project. 1675.07. Plan Review Procedure. Subd. 1. Process. Plans meeting the requirements of Section 1675.06 shall be submitted by the Public Works Director to the Planning Commission for review under Section 1675.08. The Commission shall recommend approval, approval with conditions, or denial. Following Planning Commission action, the plan shall be submitted to the City Council at its next available meeting. City Council action on the plan must be -5- accomplished within 120 days following the date the application is filed with the Public Works Director. Subd. 2. Duration. Approval of a plan shall expire one year after the date of approval unless construction has commenced in accordance with the plan,unless the applicant makes a written request to the Public Works Director for an extension of setting forth the reasons for it. The Public Works Director shall make a decision on the extension within .30 days. The Public Works Director may grant one extension of not more than 12 months. Any plan may be revised in the same manner as originally approved. Subd. 3. Conditions. A plan may be approved subject to conditions related to the requirements of this Section. Such conditions may, among other matters, limit the size, kind or character of the proposed development, require the construction of structures, drainage facilities, storage basins and other facilities,require replacement of vegetation, establish required monitoring procedures, stage the work over time,require alteration of the site design to insure buffering, and require the conveyance to the City or other public entity of certain lands or interests therein. Subd. 4. Securily. Prior to approval,the applicant shall execute an agreement in form acceptable to the Council to construct any required improvements, to dedicate property or easements, and to comply with any required conditions. The agreement must be accompanied by cash or a letter of credit in form and amount determined by the Council sufficient to secure performance of the applicant's obligations. Subd. 5. Fees. All applications f6r plan approval shall be accompanied by a processing and approval fee of$150.00. 1675.08 Approval Standards. Subd. 1. Requirements. The standards contained in this Section must be met to the degree required by the City Council. Subd. 2. Site dewafering. Water pumped from the site shall be treated by temporary sedimentation basins, grit chambers, sand filters,upflow chambers,hydro-calcines, swirl concentrators or other controls as appropriate. Water may not be discharged in a manner that causes erosion or flooding of the site or receiving channels or a wetland. Subd. 3. Waste and material disposal. All waste and unused building materials (including garbage, debris, cleaning wastes,wastewater,toxic materials or hazardous materials) shall be properly disposed of off-site and not allowed to be carried by runoff into a receiving channel or storm sewer system. -6- Subd. 4. Tracking. Each site shall have graveled roads, access drives and parking areas of sufficient width and length to prevent sediment from being tracked onto public or private roadways. Any sediment reaching a public or private road shall be removed by street cleaning(not flushing) before the end of each workday. Subd. 5..Drain inlet protection. All storm drain inlets shall be protected during construction until control measures are in place with a straw bale, silt fence or equivalent barrier meeting accepted design criteria, standards and specifications contained in the Minnesota Pollution Control Agency publication "Protecting Water Quality in Urban Areas". Subd. 6. Site erosion control. The requirements of this subdivision apply only to construction activities that result in runoff leaving the site. (a) Channelized runoff from adjacent areas passing through the site shall be diverted around disturbed areas, if practical. -Otherwise,the channel shall be protected as described below. Sheetflow runoff from adjacent areas greater than 10,000 square feet in area shall also be diverted around disturbed areas,unless shown to have resultant runoff velocity of less than 0.5 ft./sec. across the disturbed area for the one year storm. Diverted runoff shall be conveyed in a manner that will not erode the conveyance and receiving channels. (b) All activities on the site shall be conducted in.a logical sequence to minimize the area of bare soil exposed at any one time. (c) Runoff from the entire disturbed area on the site shall be controlled by meeting either subsections 1 and 2 or 1 and 3. (1) All disturbed ground left inactive for 14 or more days shall be stabilized by seeding or sodding (only available prior to September 1.5) or by mulching or covering or other equivalent control measure. (2) For sites with more than 3 acres disturbed at one time, or if a channel originates in the disturbed area, one or more temporary or permanent sedimentation basins shall be constructed. Each sedimentation basin shall have a surface area of at least 1%of the area draining to the basin and at least three feet of depth and constructed in accordance with accepted design specifications. Sediment shall be removed to maintain a depth of three feet. The basin discharge rate shall also be sufficiently low as to not cause erosion along the discharge channel or the receiving water. (3) For sites with less than 10 acres disturbed at one time, silt fences, straw bales, or equivalent control measure shall be placed along all side slope -7- and downslope sides of the site. If a channel or area of concentrated runoff passes through the site, silt fences shall be placed along the channel edges to reduce sediment reaching the channel. The use of silt fences, straw bales, or equivalent control measure must include a maintenance and inspection schedule. (d) If remaining for more than seven days,they shall be stabilized by mulching, vegetative cover,tarps or other means. Erosion from piles which will be in existence for less than seven days shall be controlled by placing straw bales or silt fence barriers around the pile. In-street utility repair or construction soil or dirt storage piles located closer than 25 feet of a roadway or drainage channel must be covered with tarps or suitable alternative control, if exposed for more than seven days, and the storm drain inlets must be protected with straw bale or other appropriate filtering barriers. Subd. 7. Storm water management criteria for permanent facilities.- Storm water Management criteria for permanent facilities shall be in conformance with the City's current Comprehensive Water Resource Management Plan. Subd. 8. Design standards. Storm water detention facilities constructed in the City of St. Anthony shall be designed in conformance with the City's.current Comprehensive Water Resource Management Plan. Subd. 9. Wetlands. Wetlands shall be maintained and protected in conformance with the s City's current.Comprehensive Storm Water Management Plan. Subd. 10. Steep slopes. No land disturbing or development.activities shall be al lowed on slopes of 18% or more. Subd. 11. Catch basins. When deemed necessary by the Public Works Director, all newly installed and rehabilitated catch basins shall be provided with a sump area for the collection of coarse-grained material. Such basins shall be cleaned when they are half filled with material. Subd. 12. Drain leaders. When deemed necessary by the Public Works Director, all d reconstructed buildings will route drain leaders to pervious areas newly constructed an g p wherein the runoff can be allowed to infiltrate. The flow rate of water exiting the leaders shall be controlled so no erosion occurs in the previous areas. Subd. 13. Inspection and maintenance. All storm water management facilities shall be designed to minimize the need of maintenance, to provide access for maintenance purposes and to be structurally sound. All storm water management facilities be inspected and maintained in accordance with the City's Comprehensive Storm Water -8- . Water Management Plan. It shall be the responsibility of the applicant to obtain any necessary easements or other property interests t allow access to the storm water' management facilities for inspection maintenance purposes. Subd. 14. Models/methodologies/computations. .Hydrologic models and design methodologies used for'the determination of runoff and analysis of storm water management structures shall be approved by the Director of Public Works. Plans, specification and computations for storm water management facilities submitted for review shall be sealed and signed by a registered professional engineer. All computations shall appear on the plans submitted for review, unless otherwise approved by the Director of Public Works. Subd. 15. Watershed management plans/Ground water management plans. Plans shall be consistent with adopted watershed management plans and groundwater management plans prepared in accordance with Minnesota Statutes Section 103B.231 and 103B.255 respectively,and as approved by the Minnesota Board of Water and Soil Resources in accordance with the state law. Subd. 16. Easements. If a plan involves direction of some or all runoff off of the site, it shall be the responsibility of the applicant to obtain from adjacent property owners any necessary easements or other property interests concerning flowage of water. Subd. 17. Lawn Maintenance Education: The City shall participate in on-going educational opportunities to inform the residents of the harmful impacts to the environment by doing any of the following: Improperly applying fertilizer; leaving or depositing grass clippings, leaves, etc.in any storm drainage area, street or natural drainage area; and, in addition, to discuss the benefits of using fertilizer containing less than three percent by weight of phosphorus. 1675.09. Other Controls. In the event of any conflict between the provisions of this Section and the provisions of any other ordinance of the City, the more restrictive standard prevails. 1675.10. Severability. The provisions of this Section are severable. If any provision of this Section or the application thereof to any person or circumstance is held invalid, such invalidity shall not affect other provisions or applications of this Section which can be given effect without the invalid provision or application. 1675.11. Effective Date. The intention of the H.R.A. and the City was to assist with redevelopment of the property located at 3901 Silver Lake Road. The objectives of the project included: A. Securing prompt renovation of the property which at the time included a portion, which was not in use. B. Secure additional employment opportunities. C. Increase the valuation of the property which decreases the tax burden. Pursuant to the contract, the H.R.A. issued a Limited Revenue Tax Increment Note in the amount of$130,000.00 at an interest rate of 9% per annum. Under the terms of the agreement, on August 1st and February 1st of each year, the H.R.A. is to make payment to the developer from tax increment monies generated by the district. The note will mature February 1, 2005 or until payment of the bond is completed. In December, the City received the second half tax settlement for 1998, which included tax increment revenues from the district totaling $13,110.36. Based on the contract the.H.R.A. . entered into, a payment is now due the developer. . .Jerry Gilligan from Dorsey & Whitney has confirmed the terms of the agreement. It should be noted that it is recommended that 10% of each year's revenues be retained to cover administrative expenses associated with the project. Recommendation: The Housing and Redevelopment Authority approve payment to Raymond A. Soil correction was financed by tax increment at a cost of$267,000 plus interest. Pursuant to the agreement, any year in which the tax increment should exceed the amount necessary to pay the costs authorized by the TIF, the H.R.A. shall (commencing 1/1/93)use the excess amount to pay for the cost of the soil correction note. Upon receiving the 1998 second half tax settlement, the TIF District's excess increment for '98 totals $66,695.58 an d is payable per the agreement. In previous payments to Norwest, 10% percent of each year's revenues were retained to cover administrative expenses. The fund balance is now adequate to cover those costs, which allows for escalated payment of the principal, which reduces interest costs. Current projections show this payment will be an annual occurrence until year 2001, which is the • last year of the District.
