r '
DORSEY & WHITNEY LLP
specify by ordinance.under what circumstances it will hold a special election to fill a
vacancy other than a special election held at the same time as the regular city election.
As I understand it, the new mayor and councilmembers would be sworn in at a meeting
on January 4. Immediately prior to being sworn in at that meeting, Mr. Cavanaugh should
submit his resignation as a councilmember. If that occurs on January 4, then less than two years
would remain, no special election is required, the appointment can be made as provided in the
statute, and the appointed person serves until the qualification of a successor.
Mike Morrison would like to begin the proce$s of collecting information regarding
potential applicants to fill the council vacancy when it occurs. I have concluded that there is
nothing wrong with collecting information on potential candidates for appointment just so long
as no action is taken prior to the vacancy actually occurring. I understand that you would like to
advertise for applicants and then discuss them at your January 4 work session. I see nothing
wrong with doing that. I understand the plan would then be to conduct interviews later in
January for purposes of considering the appointment.
,I hope this answers any questions you had, but if you have any further questions, please
let me know.
Very truly yours
. d
William R.
