ANTHONY <br /> FOR THE PURPOSE OF FLOOD RELIEF <br /> Court File No. CD 000002623 <br /> • <br /> Dear Mr. Morrison: <br /> Enclosed for your review and for consideration at the upcoming City Council <br /> meeting is a draft Resolution approving the appraisal values for the remaining Harding <br /> Street Ponding Project easements,and directing you to pay those amounts to the owners or <br /> into Court at the appropriate time. <br /> The purpose of this resolution is to allow the City to obtain the easements by <br /> approximately June 1, rather than waiting until the condemnation action is completed. <br /> Under the "quick-take" procedure used in this matter, the condemnor obtains the desired <br /> interest in real property upon approval of the condemnation petition by the Court and <br /> payment of the condemnor's approved appraisal amounts. The petition will be heard (and <br /> presumably approved) by the Court on Thursday, April 26. In the proposed order we have <br /> submitted to the Court, the payment of the approved easement amounts will be due on <br /> May 31, at which time the City will obtain the required easements and be able to start <br /> construction. As I indicated to,you when we discussed the matter earlier, it is possible that <br /> the Court may move the date on which the easements become effective if a property owner <br /> so requests. <br /> • <br />
