DATE: 8/13/01 MEETING DATE: 08/21/01 - <br /> TO: Planning Commission Members <br /> FROM: Susan Henry, Assistant City Manager <br /> RE: Request for Side Yard Variance: Maynard and Elizabeth Shaw,. <br /> 2835 Roosevelt Road <br /> Maynard and Elizabeth Shaw, 2835 Roosevelt Road, are requesting a side yard variance of 11 <br /> feet. The applicant wants to build a detached tvw-car garage measuring 22' X 24" to the east of <br /> their existing garage. According to City ordinance, "any side yard adjacent to a street must be at <br /> least 30 feet in width." The proposed plans submitted to the City by the Shaw's show a 19 feet <br /> side yard setback, which is 11 feet short of the ordinance requirement, and just 4 feet off of the <br /> property line. <br /> Maynard Shaw did mention he could possibly shave another 2 feet off the width of the garage for <br /> a width of 20 feet, making the side yard-setback 21 feet, and a variance request of 9 feet. Of <br /> course he is interested in making this garage as large as possible. Another option is to narrow <br /> the width a little between.the existing garage and the proposed garage. <br /> The Shaw attached letter includes the reasons why they believe there is hardship for their case. <br /> Much of their reasoning has to do with moving cars around with multiple cars at the propertyand <br /> . not being able to use the street for parking due to city restrictions. Also, the Shaw letter points <br /> out the lack of storage space for home maintenance equipment, like the lawn mower. <br /> For the record, City staff did not give the Shaves the impression that only 15 feet was necessary <br /> for the side yard setback from the street, as was stated in their letter. They were told they were <br /> short what was stipulated in the City ordinance, which is why they are in front of the Planning <br /> Commission this evening asking for a variance. <br /> Staff Recommendation: The City has received a completed variance application and associated <br /> materials.
