34 <br /> CITY OF ST. ANTHONY VILLAGE <br /> RESOLUTION 03 -055 <br /> A RESOLUTION APPROVING A SETBACK VARIANCE <br /> REQUEST RELATING TO PROPERTIES CURRENTLY ADDRESSED AS <br /> 3501 AND 3505 SILVER LAKE ROAD <br /> WHEREAS, the City Council of the City of St. Anthony desires to construct a new Fire Station on <br /> City-owned properties addressed as 3501 and 3505 Silver Lake Road; and <br /> WHEREAS, the City Council previously appointed Oertel Architects to construct the Fire Station; and <br /> WHEREAS, Oertel Architects has submitted a setback variance request of 11 feet for a proposed <br /> setback of 19 feet; and <br /> WHEREAS, at a public hearing, held on July 15, 2003, the Planning Commission reviewed said <br /> request and recommended Council approval for the following reasons: <br /> 1. The request is based on the City's interest to preserve trees during construction <br /> 2. Recognizing that the adjacent existing homes have a variation of 7 feet from the subject <br /> properties <br /> 3. Approval of the variance would minimize the slope and save on construction cols.ts at the <br /> eastern edge of the site <br /> 4. Not granting the variance would eliminate the retainage pond for storm water runoff that <br /> will benefit the neighborhood <br /> 5. The proposed use will not be detrimental to the health, safety, and welfare of the <br /> adjoining properties nor detrimentally affect property values. <br /> NOW,THEREFORE,BE IT RESOLVED that the City Council of the City of St. Anthony hereby <br /> approves the request for an 11 foot setback variance submitted by Oertel Architects, for City-owned <br /> property currently addressed as 3501 and 3505 Silver Lake Road,to allow construction of a new Fire <br /> Station. <br /> Adopted this day of , 2003. <br /> Mayor <br /> ATTEST: <br /> City Clerk <br /> Reviewed for Administration: <br /> City Manager <br />
