City Council Regular Meeting Minutes <br /> May 11, 2004 07 <br /> Page 7 <br /> 1 Len Pratt, Pratt-Ordway, stated not a day passed without a great deal of activity related to <br /> 2 implementing Phase I. He discussed the progress taking place and indicated time had been spent <br /> 3 working with focus groups representing St. Anthony Village residents and residents of nearby <br /> 4 communities in an effort to make certain the product was matched to the potential buyers. He <br /> 5 provided for-sale housing updates to Council, which reflected the opinions of the various focus <br /> 6 groups. He added an extra amount of time was required so "things could be done right." <br /> 7 <br /> 8 Mr. Pratt indicated he was anxious to "get onto the matters of Phase II,"noting he had begun <br /> 9 discussions with some of the Phase II property owners. <br /> 10 <br /> 11 Councilmember Horst stated Council appreciated Mr. Pratt's efforts and added an"amazing <br /> 12 amount of stuff needs to be done." <br /> 13 <br /> 14 Councilmember Thuesen asked regarding the current number of for-sale units at this time. Mr. <br /> 15 Pratt responded 264 units were planned, which would involve four buildings. He noted Purchase <br /> 16 Agreements were currently being taken for the first building in the northeast quadrant. <br /> 17 <br /> 18 Mr. Pratt explained the goal was to give each building its own identity and indicated he had <br /> 19 grown to appreciate the collaborative efforts of the architectural groups. He added two or three <br /> 20 additional elevations were being considered,noting some upper-end units were being created at <br /> 21 the suggestion of buyers. He stated plans continued to evolve as a result of the focus groups. <br /> 22 <br /> 23 Motion by Councilmember Horst, seconded by Councilmember Faust, to adopt Resolution 04- <br /> 24 041 approving extension of time line for Phase II development—Northwest Quadrant. <br /> 25 <br /> 26 Motion carried unanimously. <br /> 27 <br /> 28 C. Charitable Gambling Ordinance(1St Reading) <br /> 29 City Attorney Gilligan noted, in order to permit charitable gambling in restaurants holding on- <br /> 30 sale liquor licenses, it would be necessary for Council to amend Section 535.02 of the City Code. <br /> 31 He explained the section presently limited licensed charitable gambling to municipal on-sale <br /> 32 liquor establishments. He indicated an ordinance had been prepared amending Section 535.02 to <br /> 33 permit charitable gambling in establishments holding an on-sale liquor license. <br /> 34 <br /> 35 Mr. Gilligan stated under Minnesota Statutes the City had the authority to, by ordinance, require <br /> 36 that an organization conducting licensed charitable gambling expend all or a portion of its lawful <br /> 37 expenditure from gross profits derived from the charitable gambling conducted in the City within <br /> 38 the City's trade area; therefore, the ordinance must define the City's trade area. He indicated this <br /> 39 statute required that the trade area must include each contiguous city to St. Anthony Village. He <br /> 40 suggested Council might wish to consider imposing this requirement on licensed charitable <br /> 41 gambling; however, the requirement might be of limited value in ensuring the profits from <br /> 42 licensed charitable gambling were expended in a manner that benefited the City and its residents <br /> 43 because of the above stated requirement. <br /> 44 <br /> 45 Councilmember Faust asked if this ordinance prevented another restaurant or bar from opening <br /> 46 and having charitable gambling other than Sports Boosters.
