City Council Regular Meeting Minutes 07 <br /> July 13,2004 <br /> Page 6 <br /> .4'n <br /> 1 Councilmember Faust inquired as to if Mr. Bonniwell had any recommendations for the City in <br /> 2 managing their finances. Mr. Bonniwell stated that 2003 was a"smooth"year for St. Anthony <br /> 3 despite the implementation of GASB34. He added that there was "no cause for alarm"during <br /> 4 the audit. <br /> 5 <br /> 6 Councilmember Faust suggested that the City handled the aggressive spending, with regard to re- <br /> 7 development,well. Mr. Bonniwell stated yes, the City was "prudent"in the use of existing <br /> 8 resources. <br /> 9 <br /> 10 Mayor Hodson indicated that it was good to hear that the City is still very healthy despite <br /> 11 aggressive re-developments that has taken place and is underway. He continued in <br /> 12 complimenting Mr. Mornson and the Financial Staff for their efforts. <br /> 13 <br /> 14 VI. GENERAL POLICY BUSINESS OF THE COUNCIL. <br /> 15 A. Ordinance 04-004, Section 515 Dogs, Allowing three dogs per household and changing <br /> 16 immunization requirements. (2nd Reading) <br /> 17 City Manager Morrison reviewed the second version of the amended dog ordinance. He noted <br /> 18 this version contains the amended Immunization for rabies text. He indicated a section 515.05 - <br /> 19 Special Multiple Dog License,has been added allow the City ordinance to maintain the two dog <br /> 20 restriction but residents wishing to possess three dogs could obtain a license with the following <br /> 21 conditions: <br /> 22 a.) Written approval of the occupants from at least seventy-five percent of the <br /> 23 residential property abutting the licensed premised. <br /> 24 b.) Fenced Yard: The yard of the licensed premises is fenced in such a manner as to <br /> 25 restrain the dogs on the premises from leaving the yard. <br /> 26 c.) Nuisance: Dogs kept on the licensed premises do not create a nuisance by excess <br /> 27 barking or by creating unsanitary conditions. <br /> 28 d.) Fee: Payment of a yearly license fee of$20.00. <br /> 29 e.) Denial of application: The Chief of Police may deny requests for renewal of a <br /> 30 special multiple dog license based upon complaints received during the preceding <br /> 31 year. In the event of such a denial,the applicant may within ten days of being <br /> 32 advised of the denial, request, in writing, a hearing before the City Council on the <br /> 33 denial. <br /> 34 Mr. Morrison added these conditions place the responsibility of having the extra dog with the <br /> 35 resident,noting all provisions,A thru E are only for a third dog. <br /> 36 <br /> 37 Motion by Councilmember Stille, seconded by Councilmember Faust, to approve Ordinance <br /> 38 04-004; Section 515 Dogs,Version 2, Allowing Three Dogs per Household and Changing <br /> 39 Immunization Requirements. (2nd Reading) <br /> 40 <br /> 41 Ayes—4, Nays—1 (Thuesen). Motion carried. <br /> 42 <br /> 43 Discussion: <br /> 44 Councilmember Horst noted, as in the first reading, the complaints he has received are due to the <br /> 45 nuisance of barking dogs,not to the number of dogs. He added that he does not believe the <br /> 46 number of dogs correlates to the nuisance. He indicated the changes address the issue of <br />
