1 When questioned about. whether the Police Department had any major <br /> 2 complaints about this operation, Mr. Childs said there had been one <br /> •3 that he knew about with the exception of the suspicion expressed by <br /> 4 the owner of the Tires Plus Store that the window in his store, which <br /> 5 was broken in the middle of the night, might have been broken by one of <br /> 6 the kids who frequent the malt shop. <br /> 7 Mr. Bonaventura told the Commissioners that there are a good-sized <br /> 8 group of young people who he has forbidden to come into his <br /> 9 establishment, who hang around and smoke in the unlighted patio area <br /> 10 of the Zantigo restaurant and harass the kids going into the malt shop. <br /> 11 He said the restaurant closes at 5:00 P.M. and he has been trying to <br /> 12 get Apache to provide better lighting and security for that area after <br /> 13 dark. The shop proprietor indicated the only other thing he can do <br /> 14 about that problem is to call the Police when that happens. <br /> 15 The Commissioners agreed with the City Manager's assessment that his <br /> 16 actions in that regard were probably a "positive" for the operation. <br /> 17 After Mr. Childs had reported receiving no calls either for or against <br /> 18 the request, the Chair closed the hearing at 8:43 P.M. for the <br /> 19 following: <br /> 20 Commission Recommendation <br /> 21 Motion by Franzese, seconded by Brownell to recommend the Council amend <br /> 22 the Conditional Use Permit #88-08 which allows the establishment of a <br /> K3 malt shop at 3800 Silver Lake Road and specifies only 34 amusement <br /> 4 devices licenses for that location to increase the number of permitted <br /> 25 licenses to 45, finding that: <br /> 26 1. The request satisfies all three conditions which are required by <br /> 27 statute to be satisfied before a conditional use may be authorized. <br /> 28 2. There was no opposition to the license increase. <br /> 29 3. The Commission perceives the malt shop to be an asset to the <br /> 30 community. <br /> 31 Motion carried unanimously. <br /> 32 MISCELLANEOUS <br /> 33 Manager Asks Commissioners Whose Terms Expire in December to Submit <br /> 34 Written Confirmations of Their Willingness to Continue or Indication of <br /> 35 Inability to Serve <br /> 36 Mr. Childs told Commissioners Franzese, Wagner, and Werenicz their three <br /> 37 year terms of office were almost up and it would help the Council to <br /> 38 know now whether they wanted their names put into consideration for <br /> 39 reappointment. He said the vacancies would probably also be advertised <br /> 40 as in the past. <br /> • 11 <br />
