1 City to let Dr. Osterbauer rebuild if he had to but a blank check for <br /> 2 a different type of use was what he was concerned about,. • <br /> 3 After Dr. Osterbauer had reminded the objectors that if his son joined <br /> 4 him, their family practice would have a history of 32 years on that <br /> 5 corner, and no further comments from the public were offered, Chair <br /> 6 Wagner closed the hearing at 8 :12 P.M. for Commission comments and a <br /> 7 decision on the issue. <br /> 8 Commission Reactions to Testimony <br /> 9 Brownell <br /> 10 *said he was very sympathetic to both the "Doctor's position" and "the <br /> 11 concerns of the neighbors" ; <br /> 12 *perceived a decision to rezone would in a sense be forever and the <br /> 13 City would lose the ability to control what happens on that piece of <br /> 14 property as long as it is rezoned; <br /> 15 *was concerned that as long as a successor was a permitted use the <br /> 16 City would be unable to require them to bring in a site plan and would <br /> 17 therefore have no architectural control over the structure to be erected <br /> 18 except when it came to setbacks and signage. <br /> 19 Wagner <br /> 20 *reiterated that the same would be true of any single family home <br /> 21 which replaced another in the area; <br /> 22 *said the neighbors stood the chance of having a home they considered <br /> 23 to be "an eyesore" built next to them if the existing house burned down <br /> 24 or was demolished in a storm, <br /> 25 Franzese <br /> 26 *told Dr. Osterbauer she hoped he continued his practice in that <br /> 27 location for the next 30 years as well, but said she felt compelled to <br /> 28 vote against the change in zoning because what went in there next might <br /> 29 be beyond his control and did want to keep that area residential. <br /> 30 Hansen <br /> 31 *indicated in the interest of himself and the Commission that he would <br /> 32 be abstaining from voting on the issue because he and his family had <br /> 33 been patients of Dr. Osterbauer for more than 22_ years and his wife had <br /> 34 worked in that building at one time. <br /> 35 Werenicz <br /> 36 *concurred with Commissioner franzese's reservation about taking a <br /> 37 drastic step like rezoning; <br /> 6 • <br />
