ANTHONY "66" CONDITIONAL USE PERMIT AND <br /> VARIANCE REQUESTS <br /> BACKGROUND <br /> The conditional use permit request is required, as this property has not previously gone through <br /> this process and the proposed addition is an expansion of use. <br /> The proposed redevelopment is defined as a through lot. A through lot must have setbacks of <br /> 35 feet from all public right-of-ways. Parking area must be setback ten feet from the property <br /> line and twenty feet from the property line when it abuts a residential area. The property abuts <br /> only commercial property and two public right-of-ways (Kenzie Terrace and Coolidge Street). <br /> The square footage of the current building and proposed expansion is 2,296 square feet, which <br /> requires eight parking spaces. The Uniform Fire Code require dispensing devices to be a <br /> minimum of ten feet from property lines and buildings, which is the case in this proposal. <br /> Portions of the existing building is outside the building envelope, but this situation is <br /> grandfathered. The proposed addition requires a variance. The variance would be for 32 feet <br /> six inches. The proposed canopy requires a variance. The variance would be for 23 feet. <br /> With approving a conditional use permit, various conditions could be placed upon the business. <br /> Conditions such as: hours of operation, hours of sign illumination, and length of time and <br /> number of cars that are stored. <br /> RECOMMENDATION <br /> Recommend to the City Council the approval of the conditional use permit request and <br /> variance request based on the following conditions: <br /> (1) Parking lot must be striped for 8 spaces; <br /> (2) The canopy lighting must shine down; <br /> (3) No more than 10 cars stored on the site for no more than 48 hours; <br /> (4) Removal of roof sign; <br /> (5) New screen fencing behind building; and <br /> (6) Complete paving on east side of building up to public right-of-way. <br />
