Page 2—Culvers <br /> parking space for every 50 square feet of gross floor area, plus one for every <br /> three seats, plus one parking space for every employee on the largest shift. <br /> Based on this formula, the petitioner meets the criteria for one space for every <br /> three seats (160 seats/3), which is 53, plus one space for every employee on the <br /> largest shift, which the petitioner says is 12 employees; these two city <br /> requirements total 65 parking spaces. The petitioner plans for 70 parking <br /> spaces, per the plan. <br /> Because the City's Ordinance calls for one space per 50 square feet of gross <br /> floor area (5,815 square feet), the petitioner is short 111 parking spaces. The <br /> petitioner's variance request is for this parking requirement. See the variance <br /> application attached for petitioner's hardship rationale. <br /> 3) Combine Lot 1, Block 1, Apache Plaza with Lot 2, Block 1, Apache Plaza: <br /> The Culver's is planned for the site of the former Hardee's restaurant and the <br /> Exhaust Pro's building on Silver Lake Road. The petitioner wishes to combine <br /> Lot 1, Block 1, Apache Plaza with Lot 2, Block 1, Apache Plaza and own the <br /> restaurant at this location. <br /> 4) Rear yard setback variance request of 4.25 feet to meet the 20 feet setback <br /> requirement. <br /> In a Commercial district, the rear yard must have a depth of at least 20 feet. The <br /> petitioner is asking for a variance to meet this requirement. The petitioner states <br /> that the rear (or west) yard has 80 feet for 75% of the building and needs the <br /> 4.25 feet variance for their plans, which show 15.75 feet for 25% of the building. <br /> For consideration of this variance, the petitioner would like the weighted average <br /> or the combined setback as grounds to grant the variance. The west property <br /> line is adjacent to residential property. <br /> ADDITIONAL STAFF COMMENTS: <br /> 1) Parking spaces: Per City Ordinance, parking spaces must be at least 9 feet by <br /> 19 feet in a Commercial district; Culver's plans show these dimensions. In <br /> addition, please note parking spaces must be clearly marked and outlined, per <br /> city code. <br /> 2) Square footage of principal structure: The engineering and design drawings <br /> depict two different square footage totals. The petitioner has stated to city staff <br /> the correct and final square footage is 5,815. The petitioner will need to resubmit <br /> final plans to the City with the accurate numbers. <br /> 3) Site lighting: Site lighting consists of 400-watt metal halide lights on 25' poles. <br /> The petitioner's application states fixtures near the property lines are equipped <br /> with cutoffs to minimize light spill onto adjacent properties. <br /> 4) Garbage screening: Enclosed dumpsters noted on plans; they will be enclosed <br /> with 8" concrete block with brick veneer to match restaurant. It will not have a <br /> roof. <br />
