DeternLination of occupancy code. The occupancy <br /> code requirements for a center shall be determined according to <br /> items A to D. <br /> A. Centers serving only participants who are capable <br /> of taking appropriate action for self-preservation under <br /> emergency conditions shall meet all applicable building and fire <br /> code requirements relative to either group E-3 occupancies or <br /> group I occupancies as specified in the state Building Code. <br /> When one or more participants enrolled are nonambulatory but <br /> mobile, the center meeting group E-3 occupancy code requirements <br /> must be located On a floor level with an exit directly to grade <br /> without any intervening stairs. <br /> D_ Centers serving a population that includes both <br /> participants who are capable and participants who are not <br /> capable of taking appropriate action for self-preservation under <br /> emergency conditions shall meet occupancy code requirements <br /> specified either under subitem (1) or (2) : <br /> (1) all applicable building and fire code <br /> requirements relative to group I occupancies as specified in the <br /> State Building Code; or <br /> (2) all applicable building and fire code <br /> requirements relative to group E-3 occupancies as specified in <br /> the State Building Code; and <br /> (a) the center shall meet the staff .ratio <br /> requirements in part 9555 .9690; <br /> (b) not more than 50 percent of the center's <br /> licensed capacity shall be made up of participants who are not <br /> capable of taking appropriate action for self-preservation under <br /> emergency conditions; <br /> (c) the center shall be located on a floor <br /> level with all exits directly to grade without any intervening <br /> stairs; <br /> (d) the center shall be protected with a <br /> complete automatic detection system consisting of: <br /> i. automatic smoke detectors in all <br /> corridors and at the top of all stairways, and <br /> ii. automatic detectors in boiler and <br /> furnace rooms, kitchens, storage rooms, janitor closets, <br /> laundries, and other hazardous areas.
