SUMMARY DISCUSSION OF SUBJECT: <br /> We have had a request from a Mr. Keith Grewe to open a tanning salon in the basement of <br /> Apache Plaza (,next to the bowling alley) . This is a relatively new concept whereby <br /> people lie in a machine a couple times a week to attain a perpetual tan. Our Zoning <br /> Ordinance permits "physical culture and health gyms, spas and clubs". 1 believe this <br /> to be a legitimate operation and it is very close to fitting into that category. <br /> However, the City Attorney has recommended, and I concur, that we take a strict and <br /> conservative interpretation of this section thereby considering_ this proposal as a <br /> non-permitted use under present Zoning guidelines. The City Attorney, has recommended <br /> we amend the ordinance to allow the operation as a conditional use. This would allow <br /> the City to monitor these types of requests on a case by case basis and is placing <br /> appropriate conditions to assure the operations are. not a front for a less desirous <br /> enterprise. <br /> Initiation of Zoning Ordinance Amendments can be by a recommendation of the Planning <br /> Commission orby action of the Council . At their last meeting , the Planning Commission <br /> denied the request to hear this proposal as an addendum to the agenda, feeling the <br /> need for public input on this matter. However, there are two public hearings built <br /> into this process (see Recommendati(on) which 1 feel is sufficient for public input. <br /> The request and action for Tuesday's meeting is to initiate the Zoning Ordinance <br /> Amendment process. <br /> -------------------------------------------------------------------------------------- <br /> RECOMMENDATION (continued) : <br /> 1 . April 29th, required publication stating public hearing will be May 11th to <br /> consider- this Zoning Amendment. <br /> 2. May 11th, public hearing and first reading of Ordinance Amendment. <br /> 3. May 18th, Planning Commission input re: Ordinance Amendment. A public hearing <br /> is possible to consider the proposer's application for a conditional use per- <br /> mit (publication and notice required) . Although this cannot be approved until <br /> the Amendment is "on the books", it can coincide with the Ordinance Amendment <br /> process . <br /> 4. May 25th, Council meeting. <br /> Option a - approve second reading and table proposer's conditional use application. <br /> Option b - approve second reading, waive 3rd reading and thereby approve the <br /> Amendment. The Council could then hear the proposer's conditional use <br /> application and approve that. <br /> • <br />
