MEMORANDUM <br /> DATE: May 21, 1992 <br /> TO: Tom Burt, City Manager <br /> FROM: R. Engstrom, Chief of Police <br /> SUBJECT: PROPOSED LAKE ORDINANCE 1500:00 <br /> ------------------------------------------------------------------------------ <br /> After reviewing the proposed ordinance regulating surface water use of Silver Lake 1500:00, <br /> I have a major concern of the police department's ability to enforce those elements of the <br /> ordinance pertaining to speed, hours, and direction of travel without the resources to <br /> adequately patrol the lake on a routine basis whether by water or land during hours <br /> specified in section 4. The police department would have to rely heavily on citizens to make <br /> citizen's arrests. <br /> I am not sure if the lake has the amount of boat and jet ski traffic to warrant such an <br /> ordinance. However, if the ordinance is enacted, I would recommend that the term relating <br /> to speed "excess of five (5) miles per hour" be deleted. In order to charge or get a <br /> conviction it would require an accurate clock from a calibrated speedometer or radar gun. <br /> In conclusion if this ordinance becomes law the police department will do its best to <br /> cooperate in its enforcement. However, I view this as another burden of nuisance type calls <br /> where we get calls or complaints, but are unable to do anything without a citizen's <br /> involvement or willingness of citizens to testify in court. Subsequently, this will become an <br /> ordinance with little meaning or purpose. <br />
