A particular hardship to the applicant would result if the strict letter <br /> 3 of the regulations are adhered to; or <br /> 4 3. The conditions upon which the application for a variance is based <br /> 5 are unique to the sign or to the parcel of land for which the variance <br /> 6 is sought and are not applicable,generally, to other property within the <br /> 7 same land use classification. <br /> 8 1400.14 VARIANCES <br /> 9 Subd. 1. VARIANCES GRANTED: Variances may be granted by the Council after <br /> 10 a hearing is held by the Planning Commission and a recommendation is made to the <br /> 11 Council. Notices will be given, and a public hearing will be held, in the manner <br /> 12 provided in Section xx, Subd. xx, Item xx, of this Code's Zoning Chapter 16. MAJORITY VOTE: A majority affirmative vote of Council members <br /> 16 present is required to approve a variance. <br /> 17 Subd. 3. FEE: An application for a variance must be accompanied by the fee <br /> 18 provided in Section xx. <br /> 19 1400.15 NON-CONFORMING SIGNS <br /> 20 Subd. 1. LEGAL CONFORMING: All signs existing as of March 10, 1983 <br /> 21 conforming to the requirements of this Chapter and not requiring permit under the <br /> 22 provisions of this Chapter, may be maintained so long as they continue to comply <br /> 23 with the provisions of this Chapter, as it may from time to time be amended. <br /> 24 Subd. 2. LEGAL NON-CONFORMING SIGNS: All signs existing as of March 10, <br /> 25 1983 which would be prohibited by this Chapter, or which would require a permit <br /> 26 under this Chapter but have not received a permit, will be deemed to be legal non- <br /> 27 conforming signs. Legal non-conforming signs may continue to exist without a permit <br /> 28 and without constituting a violation of this Chapter until one or more of the following <br /> 29 occurs: <br /> 30 (1) The sign is structurally altered (except for normal maintenance) in a <br /> 31 way which makes the sign less in compliance with this Chapter than it <br /> 32 was before the alteration. <br />
