HRA RESOLUTION NO. 92- 0 9A <br /> • <br /> RESOLUTION APPROVING APPRAISALS OF VALUE AND <br /> AUTHORIZING CONDEMNATION OF ROSIE'S RESTAURANT <br /> AND GOOD LUCK CAFE PROPERTIES BY QUICK-TAKE <br /> PROCEEDINGS <br /> WHEREAS, the HRA has previously approved the Kenzie Terrace <br /> Redevelopment Plan, as amended (the "Plan"), and the Kenzie Terrace <br /> Redevelopment Project (the "Project") to be undertaken pursuant thereto, and <br /> i WHEREAS,,the properties in question are located within the area covered by <br /> the Plan and must,be acquired in order to complete the Project, and <br /> WHEREAS, the Housing; and Redevelopment Authority of St. Anthony, ' <br /> Minnesota (the "HRA") has authority to acquire ownership of property for said <br /> purpose by eminent domain pursuant to Minn. Stat. §§ 117.011, 117.035, 117.042, and <br /> 469.012,subd. 1(6), and <br /> WHEREAS, the HRA has the right to acquire title and possession prior to the <br /> filing of an award'by the court appointed commissioners, pursuant to Minn. Stat. <br /> § 117.042, and <br /> • WHEREAS, the HRA has been unable to successfully negotiate the <br /> acquisition of the required property, <br /> I <br /> NOW, THEREFORE, BE!IT RESOLVED, by the Board of Commissioners of the <br /> HRA, as follows: <br /> 1. The Real Estate Appraisal Report dated August 11, 1992, prepared by <br /> Lyle H. Nagell & Co., Inc. for the City of St. Anthony regarding the Good Luck Cafe <br /> property at 2700 Coolidge Street NE, St. Anthony, Minnesota ('Parcel 1"), appraising <br /> the fair market value of that property at $86,500.00, is hereby approved. <br /> O <br /> i ! <br /> 2. The Real Estate Appraisal Report dated June 25, 1992, prepared by Lyle <br /> H. Nagell & Co., Inc. for the City of St. Anthony regarding the Rosie's'Restaurant <br /> property. at 2905 Kenzie Terrace, St. Anthony, Minnesota ("Parcel r), appraising the <br /> fair market value of that property at$166,000.00, is hereby approved. <br /> 3. The Board has determined and hereby declares that the acquisition of <br /> Parcel 1 and Parcel 2 by the HRA is necessary to carry out the Project. <br /> 4. The Board hereby authorizes the acquisition of Parcel 1 and Parcel 2 by <br /> eminent domain quick-take procedure pursuant to Minn. Stat. § 117.042, in order to <br /> take title and possession of Parcel 1 and Parcel 2 prior to the filing of an award by the <br /> • court appointed commissioners. <br /> i <br />
