ANTHONY <br /> ORDINANCE 1993-002 <br /> AN ORDINANCE RELATfN'G TO GARAGE SETBACK PERMITS; <br /> AMENDING SUBDIVISIONS 2 AND 4 OF SECTION 1650.02 OF THE <br /> ST. ANTHONY 1993 CODE OF ORDINANCES, AMENDING <br /> SAID SECTION BY ADDING A NEW SUBDIVISION; AND AMENDING <br /> SECTION 615.07 TO ADD A GARAGE SETBACK PERMIT FEE <br /> The City Council of the City of St. Anthony hereby ordains: <br /> Section 1. Subdivision 2 of Section 1650.02 of the Code is.amended to read as <br /> follows: <br /> Subd. 2. Minimum Setback. No accessory building or any eave or other <br /> portion of any accessory building may be located within three feet of any <br /> .property line, except as provided in Subdivision 6 of this Section. <br /> Section 2. Subdivision 4 of Section 1650.02 of the Code is amended to read as <br /> follows: <br /> Subd. 4. Setback from-Principal Structure. Unless attached to and made a <br /> part of the principal structure, no eave or other portion of an accessory <br /> building may be closer than five feet from any eave or other portion of a <br /> principal structure, except as provided in Subdivision 6 of this Section. <br /> Section 3. Section 1650.02 of the Code is amended to read as follows- <br /> Subd. 6. Garage Setback Permit. A garage which will cover an area of no <br /> more than 528 square feet and no dimension of which is greater than 24 feet <br /> may be located within the side setbacks and/or rear setbacks if a setback <br /> permit has been issued for the garage under the following provisions of this <br /> Section: <br /> (a) Application for a setback permit must be made in writing on forms <br /> provided by the Clerk and must be filed with the Clerk, together with a <br /> filing fee In the amount required under Section 615.07. The <br /> application must Include a survey showing the proposed location of <br /> the structure and the structures on the property adjoining the setback <br /> in question. The application must also address the other matters to be <br /> considered by the Planning Commission and Council, as set forth in <br /> Subsection (b) of this Section. The permit application will be <br /> considered by the' Planning Commission and Council, and notice of <br /> the hearing will be given, all in the same manner as provided in <br /> Section 1665-04 for condidonal use permits. After the hearing by the <br /> Planning Commission, the Council will grant or deny the permit, <br /> stating its reasons for doing so. <br />
