PARTIAL RELEASE AND AMENDMENT OF EASEMENT KNOW ALL BY THESE PRESENTS that the City of St. Anthony, a public body organized and existing under the laws of the State of Minnesota, the holder of that certain easement for street and utility purposes as evidenced by that certain Final Certificate dated February 14, 1963, approved February 15, 1963 and filed in the office of the Ramsey County Registrar of Titles on February 28, 1963 as Document No. 453362 (hereinfter referred to as the "Easement") , does hereby forever discharge and release the tract of land lying and being in the County of Ramsey, State of Minnesota, described as follows, to-wit (hereinafter referred to as the "Release Parcel") : See Exhibit A attached hereto and incorporated herein from all claims, liens, rights and obligations of and under the Easement covering the above-described and other land. The City of St. Anthony and Northern Gopher Enterprises, Inc. , a Minnesota corporation ("Northern Gopher") , the fee owner of the Release Parcel further agree that notwithstanding anything herein or in the Easement to the contrary, Northern Gopher and subsequent owners and transferees of the Release Parcel and their respective employees, agents and contractors shall have a right of access over, across and on the land covered by the Easement for the purpose of maintaining, repairing and restoring the building and any and all other improvements from time to time located on the Release Parcel.
