Group, Inc. for the operation of a <br /> 4 convenience store with a fuel area at 2400-37th Avenue NE, based on the <br /> 5 rationale of finding of hardship as presented in the application: <br /> 6 1) Two variances to the structure, one on the south side for 7 feet and one on <br /> 7 the backyard setback for 13 feet. <br /> 8 2) Two variances for the canopy, one on the west end for 12 feet and one on <br /> 9 the north end for 20 feet. <br /> 10 Motion carried unanimously. <br /> 11 2. I.S.D. #282. for 3600 Highcrest Road (Wilshire Park Elementary Schooll: <br /> 12 Request for a Conditional Use Permit, <br /> 13 Commissioner Horst reported that the Planning Commission had recommended Council <br /> 14 approval of this request with the following conditions: ` <br /> 15 a. Limit to 24 months from the time the unit is in place. <br /> 16 b. Removal of the existing unit 60 days after the new unit is in place. <br /> 17 C. The heating and electrical systems are reviewed and approved by the • <br /> 18 Public Works and Fire personnel. <br /> 19 Horst explained that a Conditional Use Permit is required because the proposed structure <br /> 20 is considered "temporary". <br /> 21 In response to Wagner's question, Superintendent Warren Rolek explained the structure <br /> 22 will be placed at the southeast corner and that this location was selected in consideration <br /> 23 of potential future construction. <br /> 24 Motion by Marks, second by Enrooth to approve the Conditional Use Permit,request by <br /> 25 School District#282,to place two portable classroom units at the southeast corner of <br /> 26 Wilshire Park Elementary School property for a period of 24 months with conditions as <br /> 27 recommended by the Planning Commission. <br /> 28 Motion carried unanimously. <br /> 29 3. Payless Cashways. Inc. Knox): Request for an Ordinance Amendment to <br /> 30 Allow a Lumber Yard in a "C" Commercial District(Ordinance 1994-002. 1 st <br /> 31 Reading), <br /> 32 Commissioner Horst reported that the Planning Commission, by a 4 to 2 vote with one <br /> 33 abstention, recommend denial of the proposed ordinance amendment to add lumber yards • <br /> 34 under permitted conditional uses in a commercial district. <br />
