Shardlow, AICP,Dahlgren, Shardlow and Uban, Inc. <br /> SUBJECT: Public Hearing to Approve an Ordinance Rezoning the Village at St. Anthony <br /> site from Commercial to Planned Unit Development District(PUD) <br /> LOCATION: Property Commonly Known as Apache Plaza Mall, generally bounded by Silver <br /> Lane on the north, Silver Lake Road on the east, the Soo Line Railroad Right- <br /> of-Way on the south, and Stinson Boulevard on the west. <br /> APPLICANT: Apache Redevelopment, LLC <br /> i <br /> On.September 16, 2003, the Planning Commission held a public hearing to review an application <br /> for the Village at St. Anthony PUD and to consider approval of the Preliminary Development <br /> Plan and Plat for the entire site and the Final Development Plan and Plat for the retail portion of <br /> the property. At the conclusion of the public hearing, the Planning Commission voted to <br /> recommend that the City Council approve the application. . <br /> On September 23, 2003, the City Council adopted Resolution 03-81 approving the Preliminary <br /> Development Plan and Preliminary Plat for the entire project area and the Final Development <br /> Plan and Final plat for the retail portion, and adopted findings of fact and conditions of approval. <br /> On November 18, 2003, the Planning Commission will conduct another public hearing to <br /> formally consider the rezoning of the property from Commercial to PUD. This public hearing is <br /> simply a housekeeping matter to address the fact although approval of the PUD plan inherently <br /> included a rezoning of the subject property from Commercial to PUD, neither the public notice <br /> for the September 16 public hearing nor Resolution 03-81 definitively stated that a rezoning <br /> would occur through the action taken on the preliminary and final development plans and plats. <br /> Given the complexity of this project and its significance to community, a new public hearing has <br /> been noticed to clearly state that a rezoning is being considered. This is a complicated project to <br /> finance and lenders need to be assured that the property has been rezoned to an appropriate <br /> category that authorizes the development.
