ORDINANCE NO. 04-006 48 <br /> AN ORDINANCE RELATING TO SPECIAL ELECTIONS TO FILL VACANCIES I N <br /> ELECTIVE OFFICES <br /> THE CITY COUNCIL OF THE CITY OF ST. ANTHONY, MINNESOTA, ORDAINS: <br /> Section 1. Purpose. Pursuant to Minnesota Statutes, Section 412.02, Subd. 2a, the <br /> Council must specify by ordinance under what circumstances it will hold a special election to fill <br /> a vacancy in a City elective office other than a special election held at the same time as the <br /> regular City election. <br /> Section 2. Special Elections to Fill Vacancies. If a vacancy occurs in the office of <br /> Mayor and the unexpired term of the Mayor is more than 40 months at the time the vacancy <br /> occurs, the City shall hold a special election to fill such vacancy on the date set by the Council <br /> by resolution. Any such special election shall take place on a date permitted by law and within <br /> 150 days,after the vacancy occurs. If a vacancy occurs in the office of any other members of the <br /> Council, a special election to fill such vacancy may be held on other than the regular City <br /> election if so directed by the Council by resolution. <br /> Section 3.
