Childs , City Manager <br /> SUMMARY DISCUSSION OF SUBJECT: The Planning Commission completed a concept <br /> review on this request at the last meeting. The DeKanicks propose a 2 foot X 124 <br /> foot addition to the south side of their home at 3109 Wilson Street N.E. The zoning <br /> ordinance requires a 5 foot setback, where the applicant desires a 3 foot side yard <br /> setback. The neighbor to the south strongly objects to the variance and has indicated <br /> that they will take legal action if the variance is approved. <br /> The DeKanicks have also requested that their addition be defined as a "bay" which is <br /> allowed to come within 3 feet of the side property line. (See Section 12 , Subd. 3.2 <br /> (page 27-28) of the Zoning Ordinance) . The Ordinance and Building Codes do not define <br /> bays , but the dictionary calls it a "wing" of a structure, which is probably not <br /> what is intended by the Ordinance. A Planning Commission interpretation would be <br /> helpful . <br /> ALTERNATIVES: Approval or denial should have substantial reasons to support them.
