STAFF REPORT <br /> DATE: February 12, 1992 <br /> TO: Planning Commission Members <br /> FROM: David Mark Urbia, Management Assistant <br /> ITEM: APPLICATION FOR CONDITIONAL USE PERMIT FROM <br /> SHEIK'S RESTAURANT, APACHE PLAZA <br /> --------------------------------------------------------------------------------------------------------- <br /> The following report is regarding a request from Adel Alwan for a conditional use permit to <br /> allow for more than three amusement devices at Sheik's Garden Restaurant, Inc.; 3800 <br /> Apache Plaza. <br /> The conditional use permit is necessary as Mr. Alwan proposes.to have up to 30 amusement <br /> devices. According to the Zoning Ordinance, Appendix I, Section 9, Subdivision 3(14), an <br /> establishment is permitted to have more than three amusement devices (as defined in <br /> Section 51'0:05) only by conditional use permit. <br /> Mr. Alwan's proposed plan (see attached drawing) would allow him to generate additional <br /> revenue in the older, rear portion of the restaurant. The front portion of the restaurant has <br /> been renovated. Mr. Alwan proposes rules that he believes will create a family atmosphere. <br /> The three conditions are satisfied for this conditional use permit, if the owner carries out the <br /> intent stated in answering the conditions. The Planning Commission should consider adding <br /> the following conditions in conjunction with recommending approval of the conditional use <br /> permit: <br /> (1) The arcade shall prohibit tobacco, alcohol, and drugs on the premises. <br /> (2). The arcade shall prohibit individuals under the influence of tobacco, alcohol, <br /> and/or drugs. <br /> (3) Proper supervision should be available at all times to ensure appropriate <br /> conduct and behavior. <br /> (4) The access from kitchen to dining area shall be segregated to ensure safety. <br /> (5) The number of amusement devices allowed will be dependant upon the <br /> available number of amusement device licenses and available space within the <br /> area designated on the proposed plan. <br /> Additional Background Information <br />
