Alwan's iequest_for a-conditional use permit for more than three amusement devices <br /> has--been recommended for approval twice by the Planning Commission and denied twice <br /> by the City Council.' The City Council, at its May 12, 1992 meeting, elected to bring the <br /> issue back to the table for consideration. The reason for reconsideration was Mr. Alwan's <br /> request to have "kiddie rides" and "kiddie games" only. At the meeting, Mr. Alwan did not <br /> provide an adequate description or definition of a "kiddie ride" or "kiddie game." Due to <br /> this fact, the City Council referred the issue to the Planning Commission and staff for further <br /> research. <br /> INFORMATION <br /> Staff called two of the manufacturers that were provided by Mr. Alwan. Staff spoke to sales <br /> representatives from each manufacturer. Both representatives replied that there is no <br /> written definition of what is or is not a "kiddie ride" and "kiddie game." The manufacturer <br /> will have a suggested age group for a ride or game (much like popular board games, i.e. <br /> Monopoly). However, according to the representatives, a game or ride is considered <br /> "kiddie", "juvenile", or "adult" depending upon usage. In addition, a game or ride could be <br /> "cross-assigned", meaning it is used by a combination of age groups. Staff sees it difficult to <br /> define what is or is not a "kiddie game" or "kiddie ride." If Mr. Alwan was granted a <br /> conditional use permit for a given number of "kiddie" amusement devices, staff would be <br /> required to use discretion determining which games are appropriate for a"kiddie"age group. <br /> NEXT STEP <br /> A recommendation by the Planning Commission to the City Council on its findings for this <br /> issue. <br />
