STAFF REPORT <br /> DATE: September 17, 1993 <br /> TO: Planning Commission <br /> FROM: David Mark Urbia, Management Assistant <br /> ITEM: AGENDA ITEM - V. A. <br /> BACKGROUND <br /> The applicant, Jerome P. Holewa, has made application for subdivision/plat approval to allow <br /> for a all season porch addition to the townhome at 3484 Silver Lane (Lot 28). The subdivision <br /> request is necessary as additional land would need to be conveyed to the property owner to <br /> build the proposed addition. The City can elect to waive the preliminary/final plat requirement <br /> and accept a Metes and Bounds description of the land to be conveyed. I would recommend <br /> this procedure, as it will be less of a cost and time burden. In addition, the Metes and Bounds <br /> description will fully serve the City's needs. With a Metes and Bounds description, approval <br /> from Ramsey County is necessary as the property is torrans. As the property is in a <br /> Townhome Association, consent of 67% of the owners of all lots in the development and 51% <br /> of the eligible mortgage holders of the lots subject to first mortgages. This consent would need <br /> to be in recordable form. I understand an architectural review committee of the Townhome <br /> Association would also need to review the proposal. <br /> Other issues include lot coverage and setback variances. There is 47.5% lot coverage. If the <br /> patios and sidewalks/porches were included, it might be at 50%. I believe this proposed <br /> addition could be built, but it could set a precedence for others to want additions. If this <br /> addition were to be built, most certainly the 50% would be exceeded. Concerning setback <br /> variance, the Metes and Bounds description allows for one foot setback of land conveyed <br /> around the proposed addition. This would need a variance if the subdivision were to be <br /> approved. Otherwise, additional land would need to be conveyed to meet the five foot setback <br /> requirements. <br /> RECOMMENDATION <br /> If you recommend approval of the request, it should include the following contingencies: ; <br /> • pending Ramsey County Registrar of Titles approval; ` <br /> • pending Evergreen Townhome Association approval; and <br /> • obtain setback variance or convey additional land. i <br /> If you do not recommend approval, and the City Council follows the recommendation, the <br /> issue is effectively dead. <br /> If you believe the other groups should approve the proposal first, then you should table the <br /> • issue. <br /> i. <br />
