STAFF REPORT
DATE: August 20, 1996
TO: Planning Commission Members
FROM: Kim Moore-Sykes, Management Assistant
ITEM: Rear Yard Setback Variance Request --
Mike Miller, St. Anthony Health Care Center
BACKGROUND.
Mike Miller, Administrator and owner of the St. Anthony Health Care Center has filed an
application for a variance to the City's Rear Yard Setback Ordinance requirement. The
ordinance requires that the rear yard must have a depth eaqual to the greater of 20% of the
entire lot or 40 feet in an R-4 zoning district.
Because of the need to subdivide the property for the financing of the addition to the St.
Anthony Health Care Center, the rear yard of the proposed addition will be 15 feet instead
of that required by the City's Ordinance.
ANALYSIS.
Again, the variance to the rear yard setback is necessary in order to complete the proposed
addition. If the variance request is not approved, the St. Anthony Health Care facility will
not be able to alleviate the crowding conditions that four beds to a room creates.
The State of Minnesota recognized their need to build the proposed addition by granting
them an exception to the moritorium that is in place to prevent the construction of
additional nursing homes or expanding the number of beds for a nursing home facility. By
adhering strictly to the City's rear yard setbackrequirement, St. Anthony He_alth_Care
facility will not be able to construct their proposed addition, thereby causing an undue
hardship to continue to exist.
The rear yard in question is adjacent to Chandler Place, which is owned and administered
by the same owners of the St. Anthony Health Care facility. There also exists an easement
between the two existing facilities further-south along the same lot line that allows for the
transport of meals from the kitchen of the St. Anthony Health Care facility to the dining
area of Chandler Place. There will be not detrimental impact to Chandler Place should
this variance request be approved.
The purpose of the proposed variance is not based solely on a desire to increase the value
or income potential of this property, but will correct overcrowding with an updated and
modern nursing home facility.
