STAFF REPORT <br /> DATE: September 17, 1996 <br /> TO: Planning Commission Members <br /> FROM: Kim Moore-Sykes, Management Assistant <br /> ITEM: Conditional Use.Permit -- Video Sales and Rental Store; <br /> Sign Variance Request -- Video Sales and Rental Store and <br /> Bagel Shop; Lot 3, Block 4, Apache Plaza (96-14). <br /> BACKGROUND: <br /> Conditional Use Permit. Lee Stedman of Realty Development Advisors, LLC, has applied <br /> for a conditional use permit for a proposed video rental store that"is one of two proposed <br /> stores to be built as part of the Apache Plaza redevelopment plan for Lot 3. The second <br /> store, a bagel shop, is an allowed use in the commercial zoning district. <br /> The proposed video rental store is a use that is allowed in a commercial zoning district <br /> such as Apache Plaza (Chap. 16, Section 1635.03; (i)). The use will not be detrimental to <br /> health, safety, or general welfare of the people living or working in the vicinity. As stated <br /> by their conditional use application, the proposed store will not contain X-rated video <br /> tapes. The Apache Plaza location is desirable for the proposed use because it a convenient <br /> location for the community. This proposed use will not be detrimental to property values, <br /> but instead, it is expected to increase the redevelopment value of the surrounding <br /> commercial properties and the area as a whole. <br /> Sign Variance Request. Lee Stedman has also requested a sign variance for the building <br /> that is housing the video and bagel stores. As the site plan shows, the proposed building is <br /> Situated such that it has business frontage on the west and south=sides. Mr. Stedman is <br /> requesting a sign variance for the north side of the building, which has no business right-of- <br /> way frontage, to take advantage of the south bound vehicular traffic on Silver Lake Road. <br /> The proposal is to have two wall signs, one on the west side of the building that will wrap <br /> around to the south side and does not require a variance. The other sign is proposed to be <br /> on the west side of the building and will wrap around the corner to the north side. These <br /> wrap around wall signs will not exceed 15% of the area of the wall to which the sign will <br /> be applied. <br /> RECOMMENDATION: <br /> 1. Staff recommends the approval of the conditional use permit being requested by Lee <br /> Stedman of Realty Development Advisors, LLC based on the fact that the City <br /> Ordinance allows the use as a conditional use in a commercial zoning district. <br />
