Pushing the addition toward Silver Lake Road would encroach into the county <br /> 2 setback and exceed the average of the front yard depths of the adjacent lots-. <br /> 3 Ms. Moore-Sykes reported Ste. Marie Company is also requesting a sign variance for the <br /> 4 proposed addition. As the site plan shows,this addition is situated such that it has business <br /> 5 frontage on the east side, along Silver Lake Road. Ms. Rothschild is requesting a sign variance <br /> 6 for the north side of the proposed addition,which has no business right-of-way. It is being <br /> 7 proposed that the wall sign be extended to wrap around to the north side of the building, which <br /> 8 will take advantage of the southbound vehicular traffic, as well as the traffic on the Apache Plaza <br /> 9 site. This proposed wall sign will not exceed 15%of the wall area to which the sign will be <br /> 10 applied. <br /> 11 Staff is recommending the approval of the rear yard setback variance request as requested by Ms. <br /> 12 Rothschild of the Ste. Marie Company. The requested setback is from a lot line which is <br /> 13 adjoining an interior driveway intended for use by the customers of the shopping center and is <br /> _ 14 not adjoining another lot. If the request for the variance is granted, it will not alter the essential <br /> 15 character of the locality but allow the site to be redeveloped into a reasonable commercial use. <br /> 16 The circumstances causing the hardship that necessitated the need to request this rear yard <br /> 17 setback were created by the location of the site between a county road right-of-way and an <br /> 18 interior driveway through this shopping center and were not created by the'owner. It is possible <br /> 19 that as the shopping center is redeveloped, this interior driveway could change or cease to exist. <br /> 20 So, while a setback variance is required by City Ordinance,the impact of constructing the <br /> 21 proposed addition 1 foot, 6 inches from the property line that is adjacent to an interior driveway <br /> 22 is not as great as it would be if constructed adjacent to another building on the site or adjacent to <br /> 23 a residential area. <br /> 24 Staff is also recommending the approval of the sign variance request for business right-of-way <br /> 25 frontage on the north side of the proposed addition to accommodate the need for increased <br /> 26 visibility for traffic going southbound on Silver Lake Road and traffic in the retail center. <br /> 27 The conditions upon which this variance request is based are unique to this area because Apache <br /> 28 Plaza is being redeveloped into a retail center that.has independent retail businesses being <br /> 29 planned along Silver Lake Road and are not part of the main retail center. The applicant desires <br /> 30 to take advantage of the potential for increased traffic attracted to the Apache Plaza by utilizing a <br /> 31 wrap around wall sign concept to provide increased visibility to potential customers driving <br /> 32 either on Silver Lake Road or on the driveways through Apache Plaza. The applicant will not <br /> 33 require more sign surface area than what is allowable by the City's wall sign ordinance. <br /> 34 Commissioner Makowske stated the reason for allowing larger monumental signs on these <br /> 35 parcels was that they are included in the Comprehensive Sign Package for Apache Plaza. Staff is <br /> 36 now asking the Commission to consider these developments as being separate from Apache <br /> 37 Plaza. <br />
