MEMORANDUM <br /> DATE: 02/12/02 MEETING DATE: 02/19102 <br /> TO: Planning Commission Members <br /> FROM: Susan Henry, Assistant City Manager <br /> SUBJECT: Side Yard Variance Request— Ray Whitehall; 3601 Roosevelt St <br /> Requested Action: <br /> The applicant, Ray Whitehall, 3601 Roosevelt Street, is requesting a side yard variance <br /> for construction of a new single family home. Mr. Whitehall is working with Michael <br /> O'Connell of Timbercraft Homes on the construction. <br /> Background: <br /> Mr. Whitehall is asking for an 18' side yard variance to construct a new single-family <br /> home on his property located at 36th and Roosevelt. The proposed home measures <br /> 1257 square feet and has a 28' pad in width. To meet the side yard setback established <br /> by city ordinance, the proposed home would need to be a 20' pad in width. According to <br /> the city ordinance, the side yard setback is 30' from the property line. The proposed <br /> home would extend into the setback area by 18'. <br /> As a note, the existing home on the property encroaches into the side yard setback by <br /> 11'. The applicant says it is not economically feasible to remodel the existing structure; <br /> in addition, the existing home has been deemed substandard. Any improvements to the <br /> existing home would require a similar variance. <br /> For hardship, the applicant states the property cannot not be put to reasonable use <br /> under the city ordinance because the new building area would need to be 15' in width. <br /> Also, the applicant says because the lot size is 45' in width and a corner lot, a <br /> diminished building pad is created by the ordinance. A diminished building pad of 20' <br /> does not make a feasible and reasonable project. Furthermore, the applicant states the <br /> subject property was a lot of record prior to adoption of the city ordinance and it is now <br /> considered substandard. <br /> Staff Recommendation: <br /> Staff is recommending approval, given the unique facts and restrictions of the subject <br /> property. Also, this project would provide a redeveloped lot with private investment. <br /> Attachment: <br /> • Petition for Variance <br /> • Survey <br /> • Proposed Plans/Foot Print on Lot <br />
