He added that he was <br /> 2 comfortable with the proposed changes. <br /> 3 <br /> 4 <br /> 5 Motion by Councilmember Faust, second by Councilmember Thuesen,to approve <br /> 6 Resolution 02-054, re: Considering the four conditions as set by the Planning <br /> 7 Commission to allow construction of a Culver's Family Restaurant at 4000/4001 Silver <br /> 8 Lake Road. <br /> 9 <br /> 10 Motion carried unanimously. <br /> 11 <br /> 12 In addition, at their June 18, 2002 meeting, the Planning Commission recommended Council <br /> 13 approval of the following ordinance amendments: <br /> 14 <br /> 15 2. Consider amendment to City Ordinance relating to the definition of"garage" and <br /> 16 "accessory building" and to regulate the size of garages in residential districts.Is' <br /> 17 reading. <br /> 18 Councilmember Sparks asked if this ordinance would effect how something <br /> 19 would look from the outside. Stille stated that he did not think that it would. <br /> 20 <br /> 21 Jerry Gilligan stated that, regarding the particular house in question, the <br /> 22 appearance from the outside would not change. He continued that, as the code <br /> 23 reads now,the flooring of an attached garage is included in the building footprint; <br /> 241 a detached garage is not included in the floor area ratio. <br /> 25 <br /> 26 Gilligan suggested that a garage should either be included in the floor area ratio, <br /> 27 or not, regardless of whether or not the garage is attached. <br /> 28 <br /> 29 Councilmember Horst stated that he felt that a garage should be included as space <br /> 30 in the floor area ratio, but the amount of land coverage needs to be determined. <br /> 31 <br /> 32 Mornson stated that this ordinance is regarding the blueprint of the building in <br /> 33 relation to the lot. He continued that they still have to comply with lot coverage, <br /> 34 which will still restrict the size of the house as well as setbacks. <br /> 35 <br /> 36 Mornson stated that the ordinance was to control the size of the house and that <br /> 37 there still exists a lot coverage ordinance. <br /> 38 <br /> 39 Mayor Hodson asked why they would want to make such a restriction. Mornson <br /> 40 stated that they are attempting to clear up the ordinance because the inspector has <br /> 41 interpreted garages as part of the principle structure. <br /> 42 <br /> 43 Mornson added that the way that the ordinance was written benefits the <br /> 44 ' homeowner in question. <br /> 45 <br /> 46 Resident Mike Ptak, 3505 Downers Drive, lives just to the east of the discussed <br /> 47 house, which, he stated, was massive. He stated that he disagrees with the <br /> 48 Planning Commission on this issue, as he feels that the homeowner would have a <br />
