Hall, Assistant City Manager <br /> SUBJECT: Public Hearing on Secondhand Dealers and Pawnbrokers <br /> Ordinances <br /> Background: <br /> Over the past several months, Planning Commissioners have studied and discussed the <br /> newly drafted attached secondhand dealers and pawnbrokers ordinances. In March, <br /> Commissioners decided that the ordinances are in final form and ready for public <br /> hearing/City Council recommendation. <br /> Most ordinances do not require a public hearing. Thus, a public hearing is not required <br /> prior to the passage of the pawnbroker and secondhand dealer ordinances. However, a <br /> city may choose to have a public hearing, upon whatever notice the city deems <br /> appropriate. In this case, the City is holding a public hearing as a courtesy. <br /> A public hearing will be necessary next month at the Planning Commission level to <br /> amend the City's Zoning Code to allow for pawnbrokers and secondhand dealers to <br /> operate as a conditional use in commercial districts within the City. It is necessary <br /> because, for example, you would not pass an ordinance allowing pawnbrokers as a <br /> conditional use without guidelines in place in Section 566 to regulate pawnbrokers. <br /> Requested Action: <br /> Staff recommends two actions: (1) The Planning Commission should take public <br /> comment on the subject ordinances and then refer them onto the City Council as <br /> recommended adoption; and (2) The Planning Commission should call for a public <br /> hearing on May 20, to amend the City's Zoning Code to allow for pawnbrokers and <br /> secondhand dealers to operate as a conditional use in commercial districts. The <br /> recommended ordinances and Zoning Code amendment will be considered by the City <br /> Council on May 27. <br /> Attachments: <br /> • Pawnbroker Ordinance <br /> • Secondhand Dealers Ordinance <br /> • Zoning Code Amendment <br />
