Wagner, Jr. 2924 Anthony Lane North Minneapolis, MN 55418 Subject: Adult Day Care in the Industrial Zoning District Dear Mr. Wagner: I am in receipt of your request to appear at the October 21 Planning Commission. I would like to clarify for you the city process that will need to pass in order for you and/or a tenant to request a conditional use permit for adult day care in the industrial zoning district. Although I cannot predict the outcome of your requests, I wanted to give you an idea of the flow of events. First of all, on October 21, you will be appearing before the Planning Commission requesting that the City's zoning ordinance for industrial zoning district be amended to include adult day care as a permitted conditional use. After that,the Planning Commission will most likely call for a public hearing for the ordinance amendment at their next meeting, which will-be November 18. The next step in the city's process is the City Council will hold three readings on the ordinance amendment at the three consecutive meetings following the November 18 public hearing. The City Council typically meets the second and fourth Tuesdays of the month. However,their meeting dates have changed a bit in November and December. In this case, the readings would occur on December 8, January 6, and 13. There is no meeting on December 23. Keep in mind the ordinance change will need to take effect and the readings will have to have occurred before you or your tenant's Application for Conditional Use Permit(which I have enclosed) goes before the Planning Commission. I think it would be all right to file the application if the ordinance amendment is in process at the City Council level. The Conditional Use Application will trigger a public hearing for the specific request for an adult day care use in the industrial zoning district. If you go ahead according to what I have laid out above, your conditional use permit request would go to the January 20 Planning Commission meeting for a public hearing. You would need to file the Conditional Use Permit Application and fee by December 19 to stay on this schedule.
