Wagner, Jr. <br /> 2924 Anthony Lane North <br /> Minneapolis, MN 55418 <br /> Subject: Adult Day Care in the Industrial Zoning District <br /> Dear Mr. Wagner: <br /> I am in receipt of your request to appear at the October 21 Planning Commission. I would <br /> like to clarify for you the city process that will need to pass in order for you and/or a <br /> tenant to request a conditional use permit for adult day care in the industrial zoning <br /> district. Although I cannot predict the outcome of your requests, I wanted to give you an <br /> idea of the flow of events. <br /> First of all, on October 21, you will be appearing before the Planning Commission <br /> requesting that the City's zoning ordinance for industrial zoning district be amended to <br /> include adult day care as a permitted conditional use. After that,the Planning <br /> Commission will most likely call for a public hearing for the ordinance amendment at <br /> their next meeting, which will-be November 18. <br /> The next step in the city's process is the City Council will hold three readings on the <br /> ordinance amendment at the three consecutive meetings following the November 18 <br /> public hearing. The City Council typically meets the second and fourth Tuesdays of the <br /> month. However,their meeting dates have changed a bit in November and December. In <br /> this case, the readings would occur on December 8, January 6, and 13. There is no <br /> meeting on December 23. <br /> Keep in mind the ordinance change will need to take effect and the readings will have to <br /> have occurred before you or your tenant's Application for Conditional Use Permit(which <br /> I have enclosed) goes before the Planning Commission. I think it would be all right to file <br /> the application if the ordinance amendment is in process at the City Council level. The <br /> Conditional Use Application will trigger a public hearing for the specific request for an <br /> adult day care use in the industrial zoning district. <br /> If you go ahead according to what I have laid out above, your conditional use permit <br /> request would go to the January 20 Planning Commission meeting for a public hearing. <br /> You would need to file the Conditional Use Permit Application and fee by December 19 <br /> to stay on this schedule.
