August 12, 1988 <br /> • To: Members of the Planning Commission <br /> From: David M. Childs, City Manager <br /> Re: 88-19 Request from C.G. Rein Co. for a Conditional Use <br /> Permit and Sign Variance to allow the construction of a Burger <br /> King at Apache Plaza. <br /> Because Apache Plaza is within 250 feet of a residential area, a <br /> conditional use permit is required for a restaurant. The issue <br /> of hours of operation was previously handled by the City when <br /> restaurants were required to be closed from 1:00 A.M. to 6:00 <br /> A.M. . Other issues regarding traffic flow, etc. should be <br /> addressed in the Commission's review. The relevant parking, <br /> height, setback and other requirements are met by this <br /> application. The real issue is the request for a free-standing <br /> sign on Silver Lake Road. The applicant proposes 165.75 square <br /> feet of signage where only 150 square feet are allowed. They <br /> also hope to have a total of three signs including the proposed <br /> free standing sign. The fact that their setback from Silver Lake . <br /> Road is over 400 feet seems to give a good case for: vaxi�ance. <br /> The size of the freestanding sign could be reduced to--. 6 feet by 6 <br /> fee't...and reduce the total signage requested by 56 sire feet; <br /> I do not see any argument that requires the freestanding sign to <br /> • be as large as they. request. I would expect that there is solpe <br /> very comfortable middle ground that- could be found regargio' this <br /> .:issue.. <br />
