r <br /> 1 difficulties which represented a hardship because the main access <br /> 2 available into the site itself is on a service road to Apache from which • <br /> 3 the visibility of both the freestanding sign in front of. the restaurant <br /> 4 and the restaurant itself are obstructed by the gas station and vehicles <br /> 5 parked around .it. He reiterated that a northbound driver on Silver Lake <br /> 6 Road might find it difficult to identify the restaurant in time to turn <br /> 7 onto the service road because of these obstructions. The Commission <br /> 8 representative confirmed that the Commission had been convinced that <br /> 9 there was something about .the nature of the lot itself which caused the <br /> 10 hardship and not just the economic difficulties of the owner. <br /> 11 Councilmember Smooth observed the objectiveness of the report in spite <br /> 12 of Commissioner Brownell's own perspective as indicated in his vote on <br /> 13 the Commission's motion. <br /> 14 Proponents - Charlene D. and Ren R. Johnson, Hardees owners <br /> 15 Mr. Johnson reiterated that as soon as the weather permitted the <br /> 16 freestanding sign in front of his restaurant would be enclosed down to <br /> 17 the ground level. He answered Council questions as follows: <br /> 18 •the roof sign would be internally lit on only the south side facing <br /> 19 Silver Lake Road; <br /> 20 •thinks the sign he had moved off the roof looked "super" where it was <br /> 21 now but "the banners the Mobil station is able to have hide the <br /> 22 Hardees sign from northbound traffic and make a sign on the roof <br /> 23 necessary to identify the restaurant in time to turn into the service • <br /> 24 road on the other side of the gas station. "; <br /> 25 •pointed out that there was no break in the Silver Lake median- which <br /> 26 would allow prospective customers to turn around once they've made <br /> 27 that identification. <br /> 28 Councilmember Makowske indicated that, because of the residential area <br /> 29 across the street, she would like to have the sign turned off at 11:00 <br /> 30 P.M. which is the latest time the restaurant owner had said his business <br /> 31 would be open. <br /> 32 Council Action <br /> 33 Motion by Marks, seconded by Makowske to accept the recommendations of <br /> 34 the Planning Commission and grant a variance from the Sign Ordinance of <br /> 35 the City Code to allow the proposed 37.1 foot wall sign on the westerly <br /> 36 portion - of the south facing mansard roof of the Hardees Restaurant, <br /> 37 4004, Silver Lake Road, subject to the sign lighting being turned off <br /> 38 at 11:00 P.M. <br /> 39 In granting the variance (for a second sign at this location) , the <br /> 40 Council finds, as did the Planning Commission) , that: <br /> 4 • <br />
