NEDEGAARD (EVERGREEN TOWNHOMES) REQUEST FOR A SIGN VARIANCE <br /> Nedegaard Construction Company, Inc., of Evergreen Townhomes, 3412 Silver Lane, is requesting <br /> a variance to the City sign ordinance to allow four monument signs instead of the permitted one <br /> monument sign per multi-unit development. Each of the proposed signs is 50 inches by 25 inches <br /> or 8.65 square feet. The four signs would total 34.6 square feet, which is below the 50 square feet <br /> allotted by the City Sign Ordinance. <br /> If the Planning Commission recommends approval of this part of the variance, the Commission <br /> must then consider the aggregate sign surface area. Each sign monument is 10 feet by 5 feet or <br /> 50 square feet. The four monuments total 200 square feet. The City Sign Ordinance allows for an <br /> aggregate sign surface area of 150 square feet. The variance would be to allow the extra 50 square <br /> feet of sign surface area. <br /> The Planning Commission had a number of concerns when this variance request was first presented <br /> in September. Staff has since obtained additional information. <br /> Monuments: The City Attorney informed staff that if the monuments are not approved as a sign <br /> structure, they then must be considered to be part of the fence, therefore requiring a variance for <br /> the height, or removal. Staff fully informed Nedegaard that the additional monuments should not <br /> be built until the variance for additional signs was approved and that if the variance was not <br /> approved, it would be Nedegaard's responsibility to remove the monuments or obtain a variance <br /> for them. <br /> Fence Height: The height of the fence is 5 feet with the top of the post being 6 feet. Because the <br /> complex is serviced by an internal roadway, the front of the structures (facing the roadway) are <br /> considered to be the front yard, therefore the fence has not been interpreted by staff to be a front <br /> yard fence, but a side yard and back yard fence. When the setback variance was granted to <br /> Nedegaard, it was referred to as a front yard setback. However, it should have been referred to <br /> as a variance from the right-of-way. The City Zoning Ordinance requires a side yard adjacent to <br /> a street to have a 30 foot setback as well as a back yard setback of at least 30 feet. Because the <br /> units along Silver Lane consist of both back and side yards, the setback variance required would <br /> have been 30 feet, therefore having the same end result. <br /> :cjk11.20.90 <br />
