• ORDINANCE NO. 1990-010 <br /> AN ORDINANCE PROVIDING FOR THE INSTALLATION AND <br /> OPERATION OF SPECIAL LIGHTING SYSTEMS FOR CERTAIN <br /> PUBLIC STREETS; PROVIDING FORTHE COLLECTION OF COSTS AS A <br /> SPECIAL ASSESSMENT AGAINST PROPERTY BENEFITTED; AMENDING <br /> CHAPTER VI OF THE 1973 CODE OF ORDINANCES BY ADDING A SECTION 620. <br /> The City Council of the City of St. Anthony, Minnesota, ordains: <br /> Section 1. Chapter VI of the 1973 Code of Ordinances is amended to add a new <br /> Section 620 to read as follows: <br /> Section 620 - Charges and Assessments <br /> for Special Street Lights <br /> Section 620:00. Manager May Order Certain Work Done. The City <br /> Manager may from time to time order the installation and operation of <br /> lighting systems for public streets and sidewalks pursuant to Minnesota <br /> Statutes, Section 429.101 which are in.addition to and/or different than <br /> the normal street lighting installed and operated at the City's sole <br /> expense (hereinafter referred to in this Section 620 as "special street <br /> lighting"). The order will state the location and type of the special <br /> street lighting work to be done. The Manager will transmit a copy of <br /> the order to the Director of Public Works, who will then have the work <br /> done by entering into contracts for such work with the appropriate <br /> public utility company or other appropriate parties. <br /> Section 620:10. Record of Cost. The Director of Public Works will keep <br /> records of and report to the City Clerk the actual cost of all special street <br /> lighting work, and, in the case of costs to be charged prior to the time <br /> they are incurred, the estimated cost of such work. In either case, such <br /> records and reports will include the cost of all special street lighting <br /> work done or to be done and all operating costs of the City incurred and <br /> to be incurred with respect to the special street lighting. <br /> Section 620:15. Collection Before Levy as a Special Assessment. All <br /> costs incurred or to be incurred for special street lighting or the <br /> operation of the special street lighting, or such portion thereof as the <br /> Council by resolution from time to time shall determine to charge <br /> under this Section, will be charged with such frequency as the Council <br /> by resolution from time to time determines, to each owner of each <br /> separate lot or parcel of land benefitted by the special street lighting, in <br /> • proportion to the benefits conferred upon such lots or parcels. If any <br /> charge is made for a cost to be incurred and, based upon subsequent <br /> actual costs, is found to be excessive, subsequent charges shall be <br />
