I REGULAR COUNCIL MEETING <br /> 2 JUNE 8 ; 1993 <br /> 3 PAGE 12 <br /> 4 <br /> 5 <br /> 6 Over a period of many years hazardous waste and unacceptable <br /> 7 material was dumped into the Oak Grove Sanitary Landfill . At <br /> 8 the time this material was dumped it was not considered <br /> 9 unacceptable . The funds for cleaning up this material were not <br /> 10 available through the Superfund so contributors to the <br /> 11 landfill material are being held liable for the associated <br /> 12 costs . <br /> 13 <br /> 14 Numerous large corporations have been sited as contributors <br /> 15 and are being held responsible for many thousands of dollars . <br /> 16 These corporations have combined their efforts to establish <br /> 17 what other entities have contributed to this landfill in <br /> 18 anticipation that they will also contribute to the clean-up. <br /> 19 <br /> 20 One of the haulers who removed refuse from the St . Anthony <br /> 21 City Hall and Community Center Building has been identified as <br /> 22 a contributor to this landfill during the time objectionable <br /> 23 material was received . <br /> 24 <br /> 25 St . Anthony and other cities serviced by this hauler are being <br /> 26 assessed for the clean-up. St . Anthony ' s share is $15 , 000 , <br /> 27 which is fifty percent less than what will be owing if it is <br /> 28 not paid by June 30th . <br /> 29 <br /> 30 Mr . Burt and other city managers met with Senator Durenberger <br /> 31 regarding this matter . They inquired if there were Superfund <br /> 32 dollars available and requested the Senator ' s help. The funds <br /> 33 were depleted and the Senator was not effective in a resolve <br /> 34 to remove the municipalities ' liability. <br /> 35 <br /> 36 Motion by Wagner , second by Fleming to authorize the City <br /> 37 Manager and the City Attorney to settle the claim with the Oak <br /> 38 Grove Sanitary Landfill Trust in the amount of $15, 000 . <br /> 39 <br /> 40 Motion carried unanimously <br /> 41 <br /> 42 8 .
