• <br /> STAFF REPORT <br /> DATE: January 20, 1994 <br /> TO: Mayor and Councilmembers <br /> FROM: Thomas.D. Burt, City Manager <br /> SUBJECT: DESIGNATION OF CITY'S LEGAL NEWSPAPER <br /> Both newspapers that submitted bids for 1994's legal publications were sent letters requesting <br /> them to re-bid. The Focus contacted me and indicated they feel their bid was very <br /> comprehensive and chose to stay with their original bid. The Bulletin is doing the same. <br /> • The issue now comes to the actual state law referring to the lower case alphabet of 90 points. <br /> The Bulletin meets the statutory requirement, however the Focus is at 72 points. In an attempt <br /> to clarify this issue, I contacted Mark Athenson, legal counsel for the newspaper association. <br /> He has yet to return my call. <br /> In addition, I discussed the issue with John Turner of the League of Minnesota Cities staff as <br /> well as Bill Soth. Their findings are that there is no case law specifying point size. However, <br /> both recommend that it would be appropriate to accept the bid which is in compliance with the <br /> statute and how it is written. <br /> RECOMMENDATION <br /> Recommend the Council designate the St. Anthony Bulletin as the City's 1994 legal <br /> newspaper. <br /> • <br />
