'STAFF REPORT <br /> DATE: October 15, 1996 <br /> TO: Planning Commission Members <br /> FROM: Kim Moore-Sykes, Management Assistant <br /> ITEM: 96-17 -- Side Yard Variance Request <br /> Nonconforming Use Variance Request <br /> Roger Bona, Unocal, 2801 Kenzie Terrace <br /> BACKGROUND: <br /> Roger Bona, the owner of the commercial property at 2801 Kenzie Terrace, is proposing to <br /> demolish the old Johnson Meat Market building that is part of his property and <br /> reconstruct a 4,000 SF building in the same footprint to house service/repair bays' so that <br /> he may expand.his service station business. Currently, the meat market building is <br /> .approximately 10 feet into the side yard setback, which for commercial properties adjacent <br /> to residential areas, is 10 feet shy of the required side yard setback of 20 feet (1635.05, <br /> Subd. 7). <br /> Also, because the building is in the setback, by definition of the City Ordinance (Section <br /> 1660), this is a non-conforming structure. At-such the Ordinance requires the <br /> discontinuance of a nonconforming structure should there be a change to that structu.re. <br /> Mr. Bona is proposing to reconstruct a building that will be more to his needs for his <br /> service and repair busifiess. He investigated the option of renovating the old Johnson Meat <br /> Market, but trying to bring the building up to current building code requirement.s was <br /> more expensive that tea�ing down the existing building and reconstructing a I more useable <br /> facility. <br /> He has considered several other options, but he feels this one is more cost"effective and less <br /> disruptive. He was concerned t'hat if the building became an addition to the existing <br /> se.rvice station, it would restrict traffic flow and void. the parking variances he had already <br /> secured. <br /> Mr. Bona applied for and received approval in June for a conditional use permit for the <br /> expansion of the building and parking variances. Mr. Bona will not require additional <br /> consideration for parking with this proposal. <br />
