The relocation area provides Opus with some <br /> flexibility in redesigning traffic flow, while preserving direct access to Lot 5 from the <br /> northerly Silver Lake Road entrance. <br /> The Purchase Agreement also provides that the HRA will be <br /> responsible only for its proportionate share of roadways, drainage ponds and <br /> common utilities used by the HRA as owner of Lot 5. Those include only the <br /> following and do not involve the HRA in the cost of maintaining the entire <br /> shopping center: <br /> 1. The HRA's proportionate share of the Silver Lake Road entrances and <br /> the access easement. <br /> 2. The HRA is solely responsible for a portion of the sanitary sewer <br /> easement and. responsible for its proportionate share of the rest of the same • <br /> easement. <br /> 3. The HRA's proportionate share of the storm sewer easement across Lot <br /> 4 once the storm sewer is constructed. If Lot 5 is the only user of the storm sewer <br /> easement to be granted over Lot 4, then the HRA will be solely responsible for any <br /> use assessments.
