City of Saint Anthony <br /> Variance request <br /> 3601 Roosevelt St. <br /> Lot 17 Block I Soo Line Addition <br /> Eviden <br /> (a) The subject matter of the application is within the scope of the Zoning Ordinance subsection <br /> regarding variances. <br /> This request addresses the side yard setback requirements as identified by the current ordinance <br /> that prohibits building construction in the required 30' sideyard setback for comer lots. <br /> (b). Strict enforcement of the ordinance would cause undue hardship because: <br /> 1. The property can not be put to reasonable use without a variance. The ordinance creates a <br /> permitted building area of only 15 feet wide thus creating a structure that would be <br /> functionally obsolete upon completion of construction. <br /> 2. Ile subject property is a lot of record and was plotted prior to the establishment of the <br /> ordinance. Upon adoption of the ordinance the subject lot became substandard. <br /> 3. The variance if granted,would not alter the essential character of the neighborhod.The <br /> variance would provide the homeowner to construct a one-story frame single family <br /> residence, which is a predominant buflding style throughout the locality. <br /> 4. Economic considerations are not the basis of the hardship but rather the strict <br /> enforcement of the ordinance would not allow the homeowner reasonable use of the <br /> property- <br /> (c) The circumstances causing the hardship are unique to this individual property. <br /> 1. Few properties have been identified that are similar to this property spec I ificafly a <br /> substandard lot size and width and also a comer lot that fronts on two city streets. <br /> (d) The granting of this variance is in keeping with the spirit and intent of the Zoning Code by <br /> providing the homeowner an opportunity to make improvements to the subject property. <br />
